+1. definitely 0.08 is the avg the government will use.. it's probably low enough to cover x % of the general population, with avg height, weight etc.

I bet the idiot will hire a fancy lawyer and try to contest it with some stupid reason like "my client is rich, rich and stupid. rich people can do whatever, whenever. case closed"

i need to step up here and answer. If he was drunk, he wouldnt have the time to realize what he hit.

im a geneticist, not a physicist, but here we go:
if car is travelling at 230km/hour
distance in front of the car that the lights can see is approximately lets say 100 metres (to be generous), is equal to 0.1 km
braking distance is published as approx. 11.1 m/s2, about 32 meters from 100 km/hour (10000 m/3600s or in his case 23000m/3600s)

hmm, i dont know how his reaction time was, but needless to say his reaction time would have had to have been under 2 seconds (i calculate about 1.72 seconds - under ideal conditions)). Anyone care to have some fun and do the real math - travelling at 230km/hr)? Again assuming just the lights were emitting enough light for 100 m and no other light sources allowed for greater than 100 meters of view.

11m/s2 = 23000m/s = 1.72 = s

my point, fast, no reaction time.
