Exhuast flapper rattles.

Hi guys, the exhuast flap in my exhuast on my 335i seems to be making a lot of chattering noise. I don't think it's a waste gate issue. I have inspected the mechanism and there seem ps to be a lot of play. I have done the golf tee mod.

My next option is to remove the valve or tack weld it so it does not rattle around. My question is can it be removed?

When I was still under warranty the dealer installed a new one free of charge. It seems to be happening again though. I think it's related to keeping the valve open all the time
