Non catted down pipes and emissions?

I need to pass emissions and was wondering if putting a JB3 and un catted downpipes on my 07 335i 6 speed would cause me to fail an emissions test? What do you guys think?

depends on where you live, check your state laws.

What should I check for? I live in larimer county colorado.

there are three types of emissions tests

1) none
2) sniffer test - they insert a probe into your exhaust pipe and measure your exhaust gas fumes to see if they correspond with state laws.
3) obd 2 test - they plug a state computer into your obd 2 port. this tells if your o2 sensors are working / READY / catalytic converter readiness / o2 sensor heaters ready or not. if you are running catless with OEM BMW programming, you will throw a CEL (check engine light) code (since your car is running rich - your car thinks there is something wrong). some programming can trick the ECU into thinking everything is ok and the CEL goes away, but when they plug into your car, ur car still shows malfunctions.

find out what kind of code your state/county uses.
