Salute and I completely agree with you. I see whiplash examples on daily basis and from my experience 95-98% of them pretend to have whiplash.

And we all pay for it...directly or indirectly.

I had an accident few years ago where a foreign lorry ran into N/S rear panel of my car. Paul, damage was similar to yours including scratches on the wheel.

Nobody stopped at the round about and I had to call the police. To cut the long story short, it settled as 50-50 as there was not witness.

sorry about to hear about that mate. pisstake sometimes, you can be a good careful driver, but some idiot always has to come and crash into you .

in terms of accidents and claiming for it. i have had 1 really bad one which caused severe problems with my lower back( minibus reversed at 20 into a yaris which i was driving nearly wrote off the car, i was 19 then. 2007 ) , even to this day still have pains and sometimes, struggle to walk(rarely this happens) . to sum up , i didnt even do a injury claim for this due for few reasons,

1. as the owner was a nice person

2. had 3 x rays and 2 mri scans on the back. still cant find whats wrong , dammit

sorry for going off topic mate. hope the car gets fixed and hope your premiums dont go up that much

About the whiplash claims - I'm just a little stiff today, nothing major, so I'll see how I go. The OH got progressively worse through yesterday, and couldn't get out of bed for work this morning. She's made an appointment with the GP - phoned at 8am, on hold for nearly 40 minutes to be told the first available one is Friday FFS!

If it was just the wing I'd have considered asking her to settle, but she wouldn't admit liability yesterday, and on the way home from work I noticed the car's pulling to the left now. I assume that means either suspension damage or similar, and that alloy is going to either need a refurb or replacement, so for a good job it's realistically going to be upwards of £1k.

Oh dear mate, that really sucks

It could have been worse but sounds like your both feeling the pain from it, so just take full and rightful advantage of the claims system.

I know how you feel, most of the times it happens when you have a nice car and its not a good feeling, when some one hits in to you.

take some comfort in that as accidents go, this one isn't too terrible, i know you really enjoy your car, but it is just a car and it will be repaired

at least the other party are legal and have insurance, and hopefully you will get sorted without too much trouble

Update for anyone interested:

Just managed to get the car to a bodyshop for an estimate - the dent on the wheel arch will pull out, meaning that it's effectively just a fill and respray of the rear bumper and wing, and blown into the door. The alloy will need a refurb, and they don't know what damage has been done underneath so that's pending further investigation...

For the paintwork, wheel refurb and a geo check, the estimates came in at £950 and £1050!

I reckon once they've firkled underneath to work out what's wrong with the geometry, and possibly replaced any bent parts, that's going to be around £1500 easily.

Just waiting for approval from the claim managament company, and I'll get it booked in.

Europa have told me to just go ahead and get it repaired - not even asked for a selection of quotes. The wording (by the solicitor) on the OH's personal injury claim says something to the effect of "your client failed to drive with due care and attention when she drove into my client"

I probably should check, but I'm quietly confident...

Once you appear to be making a substantial claim for personal injury, then you will have a fight.

These can run to many, many thousands and have other implications.
So my guess is the opposition will pull out all the stops and aim for that 50/50.

My best pal has been waiting five years for a similar settlement and they still try to get him to negotiate a pecentage liability.
Shocking, but be prepared mate.

Paul Can I ask where you got a quote? Someone's hit the side of my dads E90 and he's looking at dent repair and a spray to the passenger door and blow in....same colour as yours actually!

Obviously he wants to go somewhere local that's gonna make a decent job.

I've gone to a place in Stafford because it's handy for being at work, and it's halfway between my house and the OH so I'm passing regularly anyway.

If you're looking for somewhere near us, I wouldn't use anyone except Talke Road Bodyworks in Bradwell. They're a smallish place but the work they do is second to none. Most of the prestige marques in and around Stoke sub out their bodywork to them, and it's not unusual to see some very nice metal on their shop floor.

Honest, friendly and sensibly priced.

I dont really blame it on people for claiming but instead the insurance companys, perhaps on advice of incompetent or corrupt assessors to allow these payouts.

My brother nudged...when I say nudged I mean most probably just touched the car in front, probably not paying enough attention in gridlocked traffic... no damage to either car not even a scrape......the other driver claimed and did indeed get paid £9k for whiplash

I would say the original poster is very unlucky and in his position would claim all I could get and offset against his premium increases that were through no fault of his own to start off with.

I know the current financial climate is crap but when did the last insurance company go bust??

Had a very nice email from Europa today - the other insurers have admitted liability so it's just a paper exercise now

The OH is (IMO quite rightly) persuing a personal injury claim, her neck is still stiff and sore almost 2 weeks on. I'm using the same firm of sols to attempt to recoup the cost of my inevitable hike in future insurance premiums. Be interesting to see what they say...

always be cautious in what you discuss reagarding claims / injuries etc on internet forums

i know for a fact insurance companies have loss adjusters searching them.

in my work i have been involved in negotiations whereby the inland revenue have used such information too, regarding employment / financial status of individuals
