That's a bloody nightmare and I really feel for you. Matt has provided some excellant information, as have others. I'm trying to rack my brain for somone who you could speak to (know loads of Solicitor but a) not local to you and b) I'd have to check their specialist areas fit your problem. There is a guy who I know who, though isn't a Solicitor, got a client of mine's 'critical illness' claim paid out (having first been refused due to alledged flase disclosure). I know he would take a 'cut' of any eventual payout but he'd speak to you for nowt if it would help or simply give you some direction. PM me your details if interested (I'll fill him in on all the details first).

Just found his website http://www.kingsdowneconsulting.co.uk/index.html He works in the same premises as me, is a client of mines, as I said helped out a client of mine (got £350k paid out!!) and more importantly I trust him; if he can't help you he'll tell you.

Totally gutted for you Can't imagine what that must feel like, and as said clearly don't give up without a fight - obviously worth the effort. I've lost a few grand on shares and stuff before, and that always feels rubbish for a bit, but you soon forget about it. Of course you're talking about a big chunk of cash, but same goes really..

What's the description of the guy who robbed you btw?

Hold on.

I thought that if you finance it you have to have the car registered in your name, you can't finance a car and then register it to someone else, however, this shouldn't affect the insurance. I could see why the finance company don't like it but I don't see why the insurers are playing up??

As far as I can see is they are saying that you are lying about the policy and the finance is their evidence.
I would call them tomorrow and ask them to put it in writing exactly why they are refusing to pay out, tell them you need this within 24 hours.
Hopefully they will make a balls up and you can catch them out like this.

Then take that letter to a solicitor and let them dissect it.

Strange BMW FS definately state that you must be the registered keeper on all of their finance documents. But I suppose the good news is that BMW Insurance and FS are teh same company, it might be worth telling BMW Finance sorry you can't pay the cars been knicked and BMW Insurance are being dicks about paying out...

Have you spoken to BMW FS?

But failing that going to CAB then to a laywer is definate next step.

If all else fails as Mikey noted if you don't own your house and you don't plan to need any credit for the next 5 years going down the bankruptcy route might be worth checking out.

I'd (personally) stay away from the CAB.

They are very 'low level' in terms of their advice in my view. And the difficulty in seeing them will compound your stress.

I dunno if those reccomending have ever used them, but when I did I found the process to be both useless and irritating. It seemed a lot like signing on - regardless of how many years you've paid taxes only to end up being made redundant, the people at the CAB (like the dole office) will still look at you and treat you the same way as they treat the rest of the scumbags that go there.

Sorry, it's a personal experience that I have.

I would much rather skip all the queues and hassle and pay £50 for an hour with a lawyer (or free even) and have a nice cup of tea etc.

Personally, the first action I would take would be as follows:

1. To ask the insurance company to confirm their position in writing.

2. To review the available evidence confirming that the main driver was the OP's father. (credit card receipts for petrol, service bills, mileage records, diarys etc).

3. Discuss said evidence with the insurer and invite their comment.

I wouldn't waste money on solicitors fees until then.

I suppose I rarely LIKE paying for anything either though, so I always try to work something in for free like a no win no fee etc. Your Scottish so you will know what I mean (lol/sorry.)

However, in this case the OP needs as close to the full value of his car doesn't he so no win no fee would only be good if the fee is ON TOP of the final settlement.

I would seriously be looking for a 'drop in' legal advice type service here. I realise they are very much the 'off the tele' kind of solicitor, but do it with a couple of them and if they both say roughly the same thing, then you know it might be worth paying £120 for an hour of a proper briefs time to go through it with and on the basis that you have a case - the legal protection we have all discussed should then kick in I believe.

Granted, it may be a big outlay to begin with, but with the full support of family I honestly believe in this kind of case, if the OP has a genuinely got a case, BMW UK wont need many letters from Solicitors to turn it round.

My view is that you put a couple of hundred quid down and hit the bastards hard, you could win the pot early... If you limp in with a pair of 2's then you may end up getting beaten on the River by an Ace which comes late to the party when your fully committed and thats it - game over.

This a really tough one and I do feel for the OP.
