BMW Lemoned my 335i today, what do I do next?

My 2008 335i has had brake warning light issue for last 6-7 months. They tried to fix it for many times and 3 weeks ago they even replaced the brake module. Waited 2 weeks for the part coming from Germany. After a week or so, brake warning light still came on with car service warning light.

I decided to contact BMW NA 1 week ago. They called me today and told me they will buy back the car from me. My situation is very unique. This is a lease car and the lease is due in 2 days. They asked me to keep the car till they contacted me again since BMW is going to buy the car back so I don't need to return nor worry about milleage. I will continue to drive for next 2 weeks or so till they ask me take the car to dealership.

My question is how BMW calculates buy back value? Based on KBB? Dealer selling price or private selling price?

My car has some imperfections i.e curb rash on rims, door dings, hand brake boot tear, driver seat tear ... etc. Do they adjust the value accordingly?

Should I bring the car to bodyshop to get the car touch painted before buyback?

Any advice is appreciated.

BMW NA will send you a statement with the buy back amount. Any charges related to the blemishes will be determined when you turn the car in. They will tell you how much for the damages on the spot. If you want to fix it yourself, just tell them that after the inspection, and set up another time to turn the car in.

Thanks a lot for the great info. Tonight while I was driving brake warning light came on again along with the triangular warning light. I'm not going to touch this car again to risk my life. I'll call BMW NA to have dealer tow the car back and wait for the settlement. I'll update it later.

If this is a leased car, there is no buyback. BMW might reimburse you for a month or 3 of payments for your inconvenience but the owner of the car is BMW Financial, not you.

You might get a break on waiving repair of any damage upon return too.

This confused me as well. If your lease is up in 3 days then I wouldn't be asking for a buy back. I would be asking for a one-time payment to compensate me for the time the vehicle was at the dealer and not available to you to use. Or, if you have your eye on a new BMW, I would be asking for buyer assistance - perhaps 3-4x of what you believe is owed to you for your time.

In other words, the car was unavailable to me for a total of 4 weeks. I would ask for 2x lease payments in cash, or 3-4x in credit towards a new BMW.

If they're offering to buy it back, when the time comes, simply ask them to show you their calculations and whether it would be cheaper at that time to turn it in as a normal lease-end, or buy it back from you as a lemon. Why wouldn't you simply take the less expensive option? (As others have noted, reimbursement for lost lease use may be most economical of all)

Do you have a buyback offer in writing from BMWNA? I wouldn't be two weeks late with the lease return otherwise... my 2c

BMW NA sent me Buyback Agreement today. Yes, it's Buyback even though this is a lease car and today is my last lease day on the contract.

They dated back the first problem occurred at 22k miles. Car is at 41700 miles now. The Buyback value is according to formula: purchase price * mileage when first time problem occurred /120000. I am basically getting 2/3 of my payments back that includes down payment monthly payments tax last year registration fee Safe guard fee.

I'm extremely happy and really proud being a long term BMW owner. When I first contacted them, I was thinking getting a couple of thousand dollars compensation but now I am totally pleased and will enjoy my new E93 M3 vert from now on.
