warranty voided?

hey guys, have a bit of a problem going on with BMW rite now. was looking for some opinions. so i own a 07 335i sedan. i have just the stage 1 vishnu, and recently i went on a 6month long world tour, and while i was gone my father took my car into BMW for regular service. when i got back to the states i called up my bmw salesman and he informed me that while i was gone my dad had brought in my car and BMW found my vishnu and not only voided my warranty, but charged me 1300 bucks, AND TOOK THE VISHNU! seriously?...is that even legal? does bmw even have the athority to do such? please let me know what actions i should take towards this. thanks in advance guys.

Damn hell no!! Void the warranty is one thing but to keep your personal property is stealing. They have no right to keep it, your car doesn't belong to them or BMW. I would be up there raising all types of hell. But why didn't you take it out before you left?

They could claim it's a safety issue and from a liability perspective have to dispose of it. I'm sure there's a lawyer out there somewhere who would sue if they returned the tune to the kid where he re-installs it and then goes and kills himself driving like an idiot at too high speed.

me too am interested in whats going to happen

as far as opinions go, i can't imagine them having the right to take your tune, i could understand them uninstalling it, but to take it..... sounds like thief to me

Dude get on that ASAP I would ask nicely say they might want to forget about the whole Void Warranty as the guy who took it stole something worth over $500 making him a Felon! Then if you don't want to return your belongings (They took a third party part of your car that is theft). To answering your question it no different at all then if some guy broke in your car and stole it. What was his reason? He wanted one?
I know you can call the cops then and there. As long as your dad did not ok it.

As sick as this would is they if safety was the problem can refuse to work on the car & at very last remove the part. Do you own it outright? Is your dad on the paper work?

I agree with others, they should not have taken your Proceed, but the other question is if you ask for it back, would/can they void your warranty at that time? Have they put some type of notes on their system, that is attached to your car, but have not sent it up to BMWNA?

I only pose the questions because of the cost of the tune vs. loosing your warranty. Granted, nothing might ever happen that you need to make warranty claim, or you might new 3 fuel pumps in the next year.

Just tell them to give it back to you, if they don't you might just have to walk away. It is not worth the cost of getting a lawyer as most will charge you at least $500 in a retainer (when I did my lemon law suit against BMW, I had to pay a $750 retainer). I know people install tunes all the time and that is a decision you make that could potentially void the warranty...everyone knows that going in. People also understand that if you void the warranty, you are screwed unless you know a good mechanic and/or have access to cheap BMW parts.

I'd begin to worry less and less about the turbo tuner and more and more about the fact you just lost the warranty, the service and the ability to get both extended on an '07 335. This is a first model year run of an engine that had, and still has to some extent, some major problems. You might even have a difficult time selling the car without said warranty or the ability to add an extended one. Your best hope is to sell to someone who is going to void the warranty anyways.
