The only thing the flap does is quiet down the exhaust due to European noise regulations. Has nothing to do with emissions.

marconi118 is right. The drivers side has a smaller resonator which is within the chamber. The passenger side has the larger resonator, which I suspect is better at attenuating low frequency drone than the drivers side. That's why the exhaust system has the flap on the drivers side to redirect the exhaust flow to the passenger side.
