How to get turbos replaced under the class action lawsuit

My car went to the dealer for the rattle and they wont do anything about the wastegate rattle.

They said the lawsuit only covers faluire and rattling is not a failure.

I know others have gotten theres fixed, what can i do guys. I need some help

The bullshit part is they Describe what my car does to a T in the 2nd paragraph of the settlement deal.

1)A slight rattle noise is considered normal operation of the mechanical wastegate valve and is not afailure of the part. No repair should be attempted for this type of rattling complaint.

2)If the noise is described as a clanking noise occurring up to six or seven times in a row during adeceleration from approximately 3,500 RPM, or during a heavy application of the accelerator without a drive gear being engaged, then continue with the procedures described in this document.

^^ this is exactly what my car does and they said its normal and wont fix it, such bullshit

Go back with the description in hand, Go to a different dealership, or call BMWNA about the first dealer.

If you can duplicate it infront of them. and show them the document. they should do something.

But i hope your rattling problem is more severe. cause most n54 have a SLIGHT rattle.

Oh mine is the worst ive ever heard. It sounds like a 70s diesel truck when you start it and its cold. Its so loud you cant hear the exhaust cause of it.

Then when you de accelerate its horrible as well.

I didnt even know there was a class action suit lol wow. But my rattle is pretty severe too..I would love to know how to get them to replace them as well as the sound IS kinda embarrasing what all applies to the suit..does it have to be under warranty still or any mileage works?

Had the same rattle...My dealership down here in West palm beach replaced them though w' no questions asked, had an awesome SA, he called me and said that even after the software update they did, the rattle wouldn't go away so they gave me whole new units. That was back in late 09" not sure if the lawsuit was active then.

Anyways, 8 Months later on new set (Even with the "updated" WG arm on the new units) The rattle started again, not as bad though but I forgot ALL about it, haven't heard it ever since I installed Procede couple years ago, Its one of the features (WG Rattle fix) I am sure JB has that feature as well.

I had the same experience as the OP, I'd really like to know how to get this problem sorted with the dealership. The sound is obnoxious and embarrassing.
