Tranny shift good, no mayor difference before or after service. Anyone else found this after opening the filter? Should i worry?

If no codes are being thrown use Chevron Techron fuel injector cleaner (concentrate). It solves rpm fluctuating upon cold start-up. Also, for most BMW problems start off by scanning your car with the Peake Research Tool. It contains the actual BMW codes. If you want to register a newly installed battery for free (just buy a $10 cable) and google/download BMWLogger

Color is generally not indicative of fluid condition or that of the trans. IIRC you didn't say how many miles. All ATF should look like that after a couple of ten thousand miles. AT failure is not dependent upon fluid.changes. They can fail on 30k mile changes or 100k mile changes.
