Am I getting hosed?

I was involved in a hit and run and the insurance agency assessed and paid the amount the body shop estimated. I asked for an estimate of a couple modifications (mtech kit) and the autobody shop said I should give them $1500 over what insurance agreed (deductible included). The autobody shop just completed the work and now they say that the total on top of what insurance paid is $2700. What should I do? If the autobody shop quoted me that kind of money before working on the car, I wouldn't have authorized, but everything was over the phone. Do I have legal standing? Help!!!

I live kind of far away and I went to this shop because they had awesome reviews. I called on the phone and they told me they would start charging 50 bucks a day for storage fees. They've had the car for 2 months.

Would be helpful to know how much insurance paid.

$2700 is the approx. cost to get the kit yourself and painted/installed by a shop.

The total damage assessed by the insurance company and agreed to by the body shop was $14,000 even. That included the collision and hail damage while the car was on the flat bed down to the shop (there was no hail damage in my area). I have a $500 deductible and they paid the second $500 deductible. The original estimate already included replacement of the rear bumper at a cost of $488 and removal and installation of the front bumper and left side skirt. The shop ordered the kit when I asked for an estimate and didn't give me a firm price until the car was done. They just said to bring an extra $1500 on top of the insurance check and everything would be good. Apparently not...

Dan, this is actually the first time I am posting in this nature...



-To begin, we picked up your vehicle via flatbed on 8/2/2011.
-Your insurance company appraised the vehicle on 8/18/2011.
-M tech kit was priced to match the price you were quoted from another source & ordered on 8/18/2011 from my local dealer. (this conversation was with me)
-we deducted the price of the oem bumper which was allowed, we deducted the labor time allowed to remove & reinstall your front bumper, & we deducted the labor time for both rocker panel moldings to be removed & reinstalled. please note, your vehicle did not have m tech kit, some extra labor is needed to switch over all necessary components for the update (no charge).
-we absorbed $500.00 off the total estimate.

-we are charging $400.00 to paint front bumper & $200.00 each side skirt.

-vehicle is complete, ready for detail, pick up tomorrow & or Friday, whichever works for you.

Yet I was quoted an extra $1500 over the phone only to find out that the new price would be $2700 after the work was done...I didn't want to "out" you on the forum, but was just asking for advice. I already talked to you over the phone and you said that the price you quoted me over the phone originally no longer holds.

That's some shady shit right there!

Do they have a signed OK to do the extra work? If it's all verbal, then it might be time to call the insurance company again.

Problem Solved.

I'm not sure where it happened, but apparently somewhere along the way there was a miscommunication, and I've come up with a solution:
As a courtesy Dan, you will be upgraded to a M Tech rear bumper at no additional cost to you. Your original front bumper and side skirts will be re-installed.

As for the additional parts-

FS: E90 Pre-LCI M-Tech front bumper conversion and side skirts painted Black Saphire Metallic(475).

Parts were purchased new OEM, painted, installed, and removed.

Blow out special!! Contact me for an awesome deal and install BEFORE Bimmerstock!
