Amigos i came across this interesting excerpt in which BMW responds to NHTSA but mind you this was all the way thru 12/2011. here's the link:

INTERESTING thought page 6 paragraph 3 i believe and i quote
"Both the BMW 335d and the X5 xDrive35d are equipped with the “M57Y” 3.5 liter engine"

I was under the impression we were a 3 liter engine NOT 3.5

Any read it ok

2009 BMW 335d  [8.00]
The 2009 335d and x5d came with the 3.5L version. BMW made the change to 3.0L for the 2010 and 2011 models.

My bone stock 2009 made 313 HP and 475 TQ when I dynod it.

Probably just some BMW report monkey being dumb. Im sure they report nonsense all the time in these on accident due to the person writing the report not really being familiar with it. Some low level finance guy that knows nothing about cars probably wrote it

Interesting: misfueling is regarded as either 1: gasoline contamination or 2: poor quality diesel fuel. The words "top tier" are in the BMW answer to solve #2. So even BMW believes in using "top tier" fuel.

Interesting that X5 was going up progressively in numbers and then fell off hard for 2012 sales.
