I am glad you are well. IMO you should not sue but rather get a lawyer to write a letter of gratitude to BMW for keeping you and your friend alive. As an indication that you have taken the accident as a learning experience, you might try to change your forum name to what your picture password is.

I have to call BS on the whole "was doing 35 max, swerved to avoid animals" story.

Inexperienced driver + night time + fast car + trying to impress a female with his driving "skills" = flying off a cliff. That's the simplest (and therefor most likely) explanation.

First, good to hear you are ok.

Second, before you "sue" for "damages" I suggest you sleep on it.

Third, no "real" attorney will offer legal advice via the forum, at least not one concerned with his/her state bar license.

Fourth, your ECU will have all the information before the crash (speed, wheel spin, RPM etc). Before you open a can of worms, I suggest you think about it bit more (especially if you are making an insurance claim).

That's pretty loco. I'm sorry to see your car in that state, but happy that both of the people involved in the accident are in good health.

I called BS on my roommate a few months ago for a similar story. "swerved to miss a deer" then did a 360 on the road and ended up in the ditch about 100 feet away. From a guy that's been in a hell of a lot of crashes (no autographs, please) if he were travlleing the speed he claimed to be (35mph) there's no way he could throw spin himself and end up off the road 100 feet away. He had to be travelling at LEAST 50 mph, which I'd assume is a similar case to the OP.

All-in-all glad the driver and passenger are ok. Could have been much worse. Probably wont have many girls riding in your car over the next 12 months. lol.
