40K Worried about warranty running out

Registered to join the fray about 335 problems, have 2007 335i with 40K on the clock. My issues:
1. Limp mode that dealer can't fix. (DANGEROUS)
2. Waste gate that rattled like a 80's built K-car, repaired once, after 15K rattle is back
3. Chirping from engine compartment that dealer can't locate
4. Central locking failure (DANGEROUS) only drivers side would open, other doors could not be operated inside or out. Fuel door locked tighter than a crabs as*
5. Car no longer recognizes i-pod
6 Dealer states they've never captured a fault

Car has left me stranded 6 times, spent 33 business days in the shop and since my mileage averages about 25K a year, I'm sweating my warranty running out.
Sorry for getting off the path a little, wanted it all in one place.
I have reported the limp mode and central locking failure to NHTSA
Never believed that BMW would put a lemon out until now and from all the posts I've read is anybody thinking class-action?

Trade it in.

Pick up a used GTR and don't look back.

#4 - Try replacing the fuse with a 20 amp (initially BMW used 15amps but they were underated). If it blows the 20 amp then an actuator is likely fault.

#5 - Mine does this from time to time, normally resolved by pugging the ipod into the Mac and doing a hard reset.

Locking module was fried on my car, the default failure mode should leave the doors unlocked and operable

Bad News.

time to cut bait. does this fall under the lemon law in OK ? i think most states require the issues start in the first year of ownership.

I agree. There is no reason to believe that the car will suddenly become more reliable than when it was new. Move on. Research what options you might have, and even if they don't apply, perhaps they would be bargaining leverage for the dealer to make it right with a trade.

As others have stated: sounds like a lemon, smells like a lemon, and walks like a lemon so it must be one.

Best of luck to you.

If they "fixed" the rattle, they probably just replaced the wastegate actuator. They almost did the same to me, but diagnosed the wastegates were actually worn, and are replacing the turbos. I would definitley take it back for the rattle, and if they replaced the actuators the last time, push them to inspect the wastegates and then for a turbo replacement.

Having to egress a BMW "Dukes of Hazzard" style is almost beyond belief, IMHO until BMW issues a fix, passengers should have a spring loaded glass punch available as catastrophic events are often a series of low probability events that line up just so

Have you contacted BMWNA in regard to your issues? I would start there and see what they can do for you...

On another note, in your trunk (which can be opened with the key inside your keyfob) above the location of your battery there is a little green tab that will pop your fuel tank open in case of electrical lock failure.

You should trade it in but get BMW NA to help you some how by calling them with your concerns and going over all your issues with the car that is unresolved. they may offer you an extendend warranty instead of taking the car back. I have heard that some people were able to get this from them. Trading it in may be a problem with the mileage and what the car is worth to a dealer. Also all those issues you have are going to be an issue with trading in on a totally different car. BMW NA needs to do something. I know they post on here from time to time so try sending them a message or make some calls. Your dealer may do it for you though depending on how good they are about customer service.

If your car has had this issue then it is a safety hazard and should be lemon lawed. That is crazy.

Hear ya Brad, but regardless of the cause, blown fuse, short circuit, a wreck, your 12 year old dropped Skittles into the defroster, it seems to me that this type of failure should leave the doors unlocked and operable

I wonder if BMW NA will help me with my over heating brand new 335 and give me an oil cooler like it should have had standard?
