Should I trust this dealer?

On 6/23/12 I bought 2011 BMW 328 e90 from a BMW dealership in Baltimore. The car had only 90 miles on it and I assumed it was brand new.

Today I learned that the car's in-service date was 8/31/2011 and therefore I have only 3 years and 2 months left on my warranty and free maintenance.

Had this fact been disclosed to me at the time of purchase I might not have bought the car.

I talked to the sales manager and he assured me that the dealership will honor the actual date of purchase as far as warranty/maintenance services are concerned.

Should I trust the dealer since I don't have any official paper confirming that. Moreover even if they honor the warranty at their dealership, what would happen if the car breaks down outside Baltimore?

Can i expect BMW USA to help me in any way to rectify the problem?

Ask them to put this in writing, if they have any intention of honoring it, they will.

Your asking the right questions.

The tough part is getting the legally binding answers.


Do you have any paperwork that shows it as a "NEW" car sale ?

Ask the dealership if "they" will honor or BMW will honor the warranty for the FULL 4 years as sold ? if the answer is them then get it in writing from GM. If the answer is BMW ask them when you can call BMW to verify the change to 4 years was made in their system ?

exhaust all options with the dealer first, then call bmw and backup your claim with them.

Just in case I also contacted a lawyer to see if I have any legal recourse.

Your only recourse is if the car was represented as New. Why would a car with 90 miles on it, meaning test drives, have an inservice date six months earlier? Also, I assume you got a hell of a deal?

I think you need to ask yourself, "should I trust myself?".
When you sign a contract to purchase a car, on top of that contract there is a box that says, condition of car "new" or "used".
You assumed a 2011 you bot in 2012 was new? Clearly you didn't even ask. Who goes into the second or possibly the largest financial transaction in one's life just assuming things? Sorry but you have no one to blame but yourself.

why not call BMW of America and ask them how much warranty left on the car ? what they tell you is what it really is.

The purchase order doesn't have any of the boxes (new, used, demo) checked off. The deal was Ok - $9k off MSRP and they gave me the full trade in value for my 2007 335.
It was Russel.

Dealerships are the most crooked individuals out there.

The Manager might not be working there 3 years from now

The dealership might close (Happening A Lot)

Get it in writing and make sure they put that info on your Car Vin so if you go somewhere else they can pull it up on a computer and see.

If they cant don't this and give you a hard time. Contact BMW Financial Services or the Appropriate Department and they will help you

I already called BMW USA and they told me that dealerships are private enterprises and BMW can't do anything about this matter. So far my emails to dealership remain unanswered. Will call them tomorrow. I'm also thinking of calling my credit card and see if they can do anything about it. I wonder if dealership is obligated to check off one of the new, used, demo boxes on the purchase order. In my case none of the boxes is checked.

Not purchase order Einstein, CONTRACT. It's a legally binding piece of paper that fully discloses all the financial information of the transaction. It has to say new or used on it. Do yourself a favor and don't get a mail order bride.

Yep. BMW USA can't really do much in many situations when dealer screws you

Some of the "NOW" 50+ sheets of paper provided by the dealer does indicate "purchase order". It's easy to get confused now a days. Please give the guy a break.

My concern is how is the "no check box" handled ... I guess do the following.

Identify exactly how much warranty & Maintenance you will loose. Calculate the $ amount.

Contact the dealer and explain you would like the warranty revised with BMW to reflect the CORRECT information, Otherwise the $$$ is as follows. Then you may want to follow up with a lawyer... pay a couple hundred and have one send a letter to the GM... might be enough to resolve it.

I was actually refering to the "bill of Sale". After closer examination of my yellow copy I found an "x" sign that is badly misaligned both vertically and horizontally. However I also found another document "We owe/You owe" (I didn't have a check on me to pay the difference after the trade) whuch has the new check box checked off. Will call the business manager who handled all paperwork later today.
