Exclamation Perillo BMW BROKE MY CAR, Help BMWNA!!

Help!! I need major help. I brought my car in for a small rattle, and when I got it back my convertible top refused to go down (a problem that wasn't there before). They've had THREE ATTEMPTS to fix this thing (they've had my car for 2-3 weeks) and so far CANNOT figure out how to FIX IT. I NEED HELP PLEASE!! Any lawyers?? Any thoughts???

I don't think this qualifies as a lemon because the DEALER broke it, the car wasn't that way. I didn't get it with trouble. Also I've had the car over a year.

This isn't a lemon situation since my car is over a year old; I need BMWNA I think to help me get the dealer to do the right thing and buy me out of this car.

Maybe there are other options? Maybe this has happened to someone else here before? Maybe someone knows a good lawyer? That's why I posted this.

I don't think things quite work like that.

What was the car in for in terms of repairs? Anything that could have resulted in the problem that arose?

What has the dealership stated is the problem with the car now?

Is it possible that the timing is just coincidental?

Has a regional rep looked at the problem or has the dealer opened a PUMA case?

In this case it sounds like you will have to work your way through channels.

Hopefully you are enjoying a nice 3er Series loaner in the interim.

I checked the state of IL lemon law website and it says it only applies if the car has less than 12 months or 12,000 miles, my car is 14 months old.

The car originally went in for a rear deck rattle, they fixed the rattle and they broke my top in the process!

Not sure what you mean by what they state the problem is, the problem is and has been since they created it, that my top will not go down. They thought they'd fixed it twice and when I went down to pick it up both times I'd try to put the top down right in their garage and in both cases it didn't work! They have no clue clearly.

The car has been in their possession for about the last 3 weeks.

Not sure how the timing is coincidental, they've had the car the whole time. It's the same problem they don't know how to fix it.

Not sure what a PUMA case is, and they won't tell me if a regional rep has seen it or not.

I'm beyond livid. Especially since they broke it in the first place!

Loaner - the first time I wasn't even offered a loaner, now I have an E46. Not an E90 loaner.

They don't work on Saturday's at this dealer anyway. Not sure why today would make any difference anyway. They've had three weeks.

The uniqueness of this situation is that Perillo BMW broke my car, it's not a lemon (even besides the age) because the mfr didn't give me a crap car; Perillo just had it in their possession and broke it themselves. And so far they don't want to give me any compensation!

Got it, thank you very much. I've also opened a Better Business Bureau complaint, thankfully the dealer is a member. (why they would be perplexes me given the service level!)

well they should have a puma case filed with bmwag.. they only talk to them through email but usually get a response within a day or they have a team that diagnoses problems and how to fix them.. once we had an amg s55 in for one month b/c of a trunk malfunction.. shit happens. coming on here ranting for lawyers is kind of crazy.. you think perillo is trying to screw you over? why not call joe and talk to him or call the service manager.. if you live in the city which you obviously do if you go there for service i would just stop by and talk to them.. i have never been there but i am sure if you go there you will get answers.

and to be totally honest they didn't break your car ok.. your car broke.. i am sure they weren't messin around with the convertible.. they have tons to play with as it is.. what foul play would you suggest. they are probably waiting a day or 3 for answers then they try it and it doesn't work.. so they have to wait longer.. sometimes a week for an unresolved issue or a first time incident. hence if the answer doesn't work they have to wait again.. but to say they have single handily broke your car..that's just crazy. i mean if you lent your car out for a day and your buddy put the top down and up.. and did everything perfectly then gave ift back to you.. would you scream for lawyers to sue him or for legal action? i just don't understand. an issue like this sometimes takes a lil time!!

A BMW engineer should take a look at the car, along with the PUMA case. I would probably get a statement from the dealer in writing that they did break it and take the car directly to another dealer, or better yet get a flatbed tow from that dealer to another, so they can't accuse you of doing it because the miles changed. Then have the dealer pay for the tow.
