because I'm an idiot who was looking for the lowest monthly rate possible and every other insurance company was quoting me 600-800 a month and Geico gave me about $400 with the $2500 deductible.

good lord man... are you 16 or something? At that cost and deductible, I'd prefer to commute with a motorcycle.

My deduct is 1k but thats because that was the lowest they offered with my plan, it includes vanishing deductible so every year it goes down i think its at 800 or something now. When i lived in ny insurance as like 3500 a year in ct my ins is 1600 a year huge difference.

Since my insurance is accepting 100% liability would I still be able to go after the truck drivers (even though I'm at fault, he didn't have to be a dick and hit my car) insurance to see if I could recoup some of the deductible?

Wait a minute. What on earth did you do in the past to warrant companies quoting you $7K-$10K a year for insurance? I know NY rates are high, especially for young drivers, but not that high. Either this wasn't your first claim or you've gotten some serious tickets/points in the past.

Also, why would you even consider filing a claim if all you're going to get them to cover is $460? Not only are your rates going to skyrocket even more for at least the next three years, the chances of you being able to switch to another company will be between zero and none. You will have moved from the "high risk" category to the "avoid like the plague" category.

No, you can't. The truck hit you because you went into his lane knowing he had no room to stop.
If police report and insurance company is putting you 100% at fault you have no ground to stand on.

This is my first car(honestly have no idea why all the quotes I got were so high)...first time in an accident...I assumed the first thing you do is call your insurance company...I also assumed they would do some form of investigation (need police reports and what not), they just took my statement over the phone and said I was at fault. When she said that, I told her I wasn't ready to file the claim yet..I want to get everything straightened out at the scene first. When I called back to follow up they said the claim was already filed...

$400 a month insurance is highway robbery for any BMW. That's $5k a year down the drain.

I pay $100/mo Allstate full coverage. 100/300/100.

At $400/month, I would have to own either a Lexus LF-A or Gallardo.

He had room to stop because he was already stopped....and there isn't a police report ready yet (I checked online and called and they said it wasn't filed yet.)

I wouldn't do anything yet without a police report. You'll need to see the police report first. If the police report puts you at fault you can expect your rates to go up.

The only way your rates won't go up is if you were 100% not at fault. (even then in some insurance companys they still go up). You still are liable for your deductible however if the insurance company thinks that the trucks ins should be paying they will duke it out.

Holy shiznit at a $2500 deductible. Progressive charges me $140 a month for full coverage with $5k in additional coverage for mods, the "OEM parts used" clause, and a $500 deductible, and I've been nervous that 500 bucks might be too much of a deductible. I just turned 29 and have a clean record except for one minor speeding ticket 2-3 years ago.

I find some things hard to believe. So Geico said you were at fault. Do you have something else to show that you weren't? A police report or something? If so, you'd want to get that. FAST. They don't care about seeing a report b/c they're already prepared to make money off you again.

There is no way you can "go after" the truck driver at this point. If anything, expect that he comes after you for his damages since you've admitted fault. Since it's probably a rented? Penske truck, he would probably have to settle things with Penske on his own or Penske will come after you to pay for damages to the truck (if any).

In this case, you probably shouldn't have involved your insurance. Best advice is to pay for it out of pocket unless you never want to see your rates go down.... and another thing - get a bike of sorts. Geico has already made a killing off you with those rates.

Yeahhhhh you might wanna think about paying the full repair bill outta pocket so your insurance rates don't get jacked up even higher (if that's possible). I proudly pay $459 every six months with State Farm for full coverage. Guess it helps that I've been with them with a car since I was 16 and now I'm 30.

wow $400 a month just for insurance. I guess they really rob young/new drivers to drive nicer cars. Quarter panel replacement is not cheap, Im guess thats the bulk of the 3k bill.

You hit his car.
You even said you were trying to get around his truck. You were in the merging lane and are supposed to yield.
You will get nothing.

that deductible is insane. You should cut a deal with a shop for like 2 grand and tell insurance to go fuck a goat. and next thing is next, call costulessinsurance.com. When my driving record was a little eeh I used them and got an amazing deal.
