Lemon & Manufacturer Buyback...would you?
Guys,
I have just started reserching the E92 335i as I'm back in the market for a BMW and really am after the N54 motor. I've come across one car that really caught my eye. It is in fantastic condition and completely loaded. It has all 3 packages + NAV, 19" wheel package, etc. 2009 6A car with 25k on the odometer...asking $33. It does, however, have the following disclaimer attached to the ad: Note: This 2009 BMW 335i Sport Coupe, was reacquired in California by BMW North America after the last retail owner or lessee requested its repurchase. Non-conformity reported by original owner: "Vehicle has reduced power and engine malfunction light on while driving." BMW graciously repurchased the car from the owner and corrected the issues under the manufacturer's warranty. BMW simply - "Replaced high pressure fuel pump and cleared adaptation values." BMW will very commonly repurchase vehicles to ensure a 100% customer satisfaction. This 2009 BMW 335i Sport Coupe has remaining balance of BMW Manufacturer's Warranty for 4 Years/50,000 miles valid until 12-14-2012 or 50,000 miles whichever comes first. Further, this car have also NO COST $0 - FREE BMW Maintenance Program for 4 Years/50,000 miles valid until 12-14-2012 or 50,000 miles whichever comes first. Extended Warranties up to 100,000 miles valid in any US & Canada BMW Dealership are Available - Please Inquire. Very Important Note: BMW has extended the warranty of the High Pressure Injection Pump (HDP) from 4 years or 50,000 miles to 10 years or 120,000 miles, whichever comes first. Details are contained in SIB B 13 03 09. Was this a normal course of business for BMW regarding the N54 HPFP issue? Would you steer clear of this car? It's a great car in a color combination that I prefer. I'm not sure if the asking price reflects the lemon title, however. Lots of funny stuff out there...I even came across another BMW CPO car and was provided with the following: Thank you for the inquiry regarding the 2009 BMW 335i. I wanted to let you know that it is still available and I’ll be happy to assist you in any way that I can. It has been run thru BMW’s strict Certification Program and was serviced by our BMW technicians. We have also taken the effort to run it thru a reconditioning process to help make sure it’s one of the nicest BMW’s available. I do want to make sure I tell you that this car has a new, remanufactured engine and clutch, both from BMW in it. This is was done as a result from an over-rev by a lot guy. Everything is still under CPO and we worked with BMW during the process to make sure coverage would remain on the car. Lot guy... Thanks for your input.

Basically a new motor and clutch, If you plan on keeping it for a while i think i'd do it.
and try for maybe 31K? |

I have an 08 e92 335i with the lemon/buyback title from CA, for the same reason, HPFP. I would pull the trigger...resale might be an issue, but i plan on keeping it for a long time, perhaps you will too.

Becuase of the nature of that recall I would have no issue. If it were failure to drive in some manner, or electrical I would run away screaming. A lemon based on the known HPFP I wouldnt question.
I work in car sales, Ive driven many many many cars. Some salvaged, some totaled, Ive purchased 1 lemoned car and many accident cars. Lemon makes it hard to finance for some banks. Take it for a spin, get a short warranty and live life in the cheap lane like me! This is how I buy cars even though I work at a Ford store selling new cars all day long. |

Assuming apples and apples. I would pay 25% less value to value on a lemon or wrecked car. I make sure the repairs are above par, and it runs as it should. But if the car NADA retail is say 30k, I would ask 22500 for it. Which is exacly how I bought my E92. The car may seem like a great deal to you, but what about the next guy buying it, always assume the worst in terms of values after the sale.

California Lemon Law on an N54 HPFP? Easy as stealing candy from a baby. In every other state you're stuck with the car.
I would get it, it has the Balance of Factory + CPO, you're fine. Get it and be happy, and the Cobb tune has a shadow map for Warranty work. |

Doesnt matter what it was, work was done and if it shows on a car fax it was still done. I like your attitude though. Does everyone in the known world that might be interested in buying that car know what a HPFP is, or why they may have been replaced. If he buys it and in a year trys to sell it or trade it, guess what its worth a whole lot less than if it were a clean retail car. Im sure this wont be the last car the OP ever owns. In 2 or 3 years when hes offered 5k under trade in and questions it, he will have the answer. So the real question is, did you read the original post?

agree with this guy. whatever you're saving upfront on the purchase price due to the lemon-ing, you will probably lose even more when trying to sell it

thanks for the input... i get that i would have some explaining to do at the time that i would put it up for sale. i would hope that a BMW enthusiast would understand the BMW buy-back program. there are so many cars that fall into this category.

People are selling salvage and branded title cars for too much these days. I used to exclusively buy them but lately every one I find is at 85 or 90% of the price of similar non branded title cars so I've switched to clear titles.
If you can get it for 25 to 30% below similar non-branded cars then I would do it. Especially if you are going to keep it until it has a lot of miles. At the price you would sell a 130k mile car people are less concerned about title branding. |

I think they want too much.
No more than mid $20's because it's close to the end of the warranty and maint. since it's a 2009 and a buyback. If it has a buyback or lemon title, it's definitely worth substantially less on the market than a similar car without the stigma. |

$33k is way too high. I just had my 07 335i lemoned, and found/bought a loaded 09 e92 335i CPO for $34k within about 5 days of looking. Not to mention it has a later in-service date (9/09) which is one of the most important factors imo.
There are plenty of 335i's out there, no need to settle for a lemoned one unless the price is a steal. Broaden your search area, I live in Nor Cal and bought mine in Vegas... Somewhat related, lemoning my 07 335i w/93k miles was so easy it's almost unbelievable. |
