Trial by declaration does not require a court appearance. Most cops do not get paid overtime to respond in writing, they do, however, for court appearance. Most people abhor paperwork. The odds are in your favor...play the odds.

You won't win simply because they mispelled your name. Only if they cited the wrong Statute you violated.
If the cop shows, you probably lose. Continue it a few times and the cop may not show. |

You can always bring it to a lawyer and see if they can drop it to a parking ticket for you. No points on your license.

I only ever went to court on one ticket of mine. Running red and I had some good proof I did not but in the end it was his word against mine.
The judge did however cut the fine in half and let me do traffic school. So for all the court hassle, you could try to get the fine reduced a bit. But what are you really gonna say: "sorry judge, I was speeding but am here hoping the cop would show or you would reduce my fine" Probably won't go over well. Pay it and go to online traffic school. The cop lowered your speed so you would be eligible to do that. Super easy and took me about 45min (at work. Hehe) |

I had gotten a speeding ticket where the cop got the make and model of the car wrong and butchered the spelling of my last name.
All the cop had to do in court is state under oath that it was me who he gave the ticket to. |

Aircraft Detected How does it work? Aircraft detected speeding violations work by clocking the time it takes a vehicle to travel between two fixed points on the ground. Two marks are placed on the highway. One at the beginning and one at the end of a marked and measured area. A vehicle is observed first, to be travelling at a rate of speed higher than the surrounding traffic. Once the vehicle crosses the “beginning” mark, a stopwatch like device is triggered to measure time. When the vehicle crosses the “end” point, the time is switched off. Basically, the amount of time it takes to pass between the marks is calculated and an exact speed is immediately available. Can it be inaccurate? There are a few disadvantages to airplane speed detection, which can work to your benefit in court. Usually, the officer uses the airplane to pace the vehicle on the ground to obtain their speed. You can point out to the court that airplane speeds are measured in air speed, which is relative to the surrounding air. If the airplane is traveling into the wind, the speed is slower than if the aircraft was producing the same amount of power with a tailwind. It may be difficult to determine whether it was actually your vehicle that was spotted from the air, since many cars look alike from such a great distance. Another problem is that this system relies on two different officers. Both officers need to be present in court for a conviction. If both officers show up at your hearing, you can request that one of them be removed so that each may be questioned individually. If their testimony contradicts one another, this may show cause for reasonable doubt.

I don't think you will get out of it based on a name misspell. That's just wishful thinking. I'd suggest manning up and paying the ticket since you were breaking the law.
Or just get a lawyer, pay them enough and you will get out of it.

Why don't you just fight the ticket. I have had 7 tickets already and I fought every one of them. I mean why would you just accept it and pay for the ticket when you have a chance in dodging it? I got out of 2 tickets already. 1 time was when the cop wrote the wrong code violation but he wrote the correct name and other time was when I was caught driving on suspended license and the cop didn't show up twice because he was injured on duty, he didn't show up first time and they rescheduled it and I asked for it to be dismissed, luckily second time he didn't come either. So just keep rescheduling as much as possible and fight it!

You knew the rules. You broke said rules. You got caught. You were even given a break on the speed you were written up for. Just own up, pay up, and move on. I don't mind much when people break more "minor" rules, but if you're caught, don't try to weasel your way out of everything.

Rules, laws, responsibility, accountability, etc.
Can someone please explain why the "SPEED LIMIT" rules are implemented? Safety or revenue maker? Are you fighting the ticket because you were not doing anything unsafe or are you fighting the ticket because you don't want to be hit in the pocket? Is speeding really a morality call that we tell people to "man-up", "take responsibility for their actions", etc.? |

I really have to take more photos. This is my son posing in front of what he hopes to be his inheritance. Took delivery about a year and a half ago. Speeding tickets so far, 3...I don't even drive it that much.(I really deserve speeding tickets more when I drive my Honda). I manned up or weaseled out (depending on your point of view) and fought, no lawyers involved. I won (if you can call it that)all three.
