You have the car. I don't see the problem.

The fact that they gave you the car means the transaction was concluded (a contract needs an offer, acceptance, and consideration).

Could you please be MORE SPECIFIC about what is going on?

from what I have gathered so far, the dealership doesn't sound like they're ripping you off or anything, they actually offered to refund you the money you paid for the extended warranty

but he bought the car because it has warranty, if it didn't then he wouldnt buy it...

True, but he said the ext. warranty was a deciding factor for him to purchase.

I get that part. Not sure why he needs an extended warranty, but thats his business.

What I dont get is why the dealership says the extended warranty they sold him is invalid? Without knowing the reasoning we dont know if its really the dealerships fault or the OPs fault. And that will really determine what course of action the OP should expect. What caused a piece of paper that guarantees service 4 years from now to become invalid?

We understand you want the deal you had. But there is more to this than just your side. Why isnt the warranty valid? Have you tried going in to talk to the dealer (not jsut 2 phone calls)?

Stop talking in these strange analogies. Give us the facts for this issue and we will give you the advice for which you ask. But please stop making up these stupid scenerios b/c they dont show us why you should get a warranty or not get a warranty. Give us ALL the facts of YOUR case... not a hypothetical scenerio.

Rick1-10, please don't take offense, but can you provide more details on what actually happened? you're giving us a lot of "what if's" and hypotheticals not pertaining to the story at hand.

Tell us more about what happened to you at the dealership so we understand.

When you find out WHY the warranty isnt valid then we can give you more advice. So far none of us (including you) has enough info on why this has happened. Depending on why it happened then we will know if their offer to refund is adequate or if they should be giving you a valid warranty. Sorry, but the only advice I have is to go in and talk to the dealer if he doesnt call you back. Be firm, but polite about what you expect. And report back with WHY they invalidated your extended warranty. Good luck.

Ok... now you got me curious. What kind of warrenty did they sell you that is not valid? Did they misrepresent what it offered.

Just so you know, extended warranties are highly advised against when purchased with a new car. In 99% of the case it is best to wait until the 4 year mark when the current warranty is about to expire to consider an extended warranty. For some reason if you sale the car earlier, or it blows up in an accident you never get that money back.

Explain more why the warranty is not valid. Dealer is only trying to do what seems fair and that is givng you your money back. Now if you financed everything all together then maybe I can understand; your monthly payments reflect the warranty that you dont have. Is that what your concern is?

This "warranty was not valid" is ...... All extended warranties are the same from all BMW dealers, unless they're selling you a 3rd party one.

I'm guessing it's the same thing that happened when I bought a Motorola RAZR right after they came out almost 2 years ago. Cingular sold me insurance on it, then promptly cancelled it because it turns out they weren't going to cover the RAZR.. probably fearing too much claim risk.

The warranty company here probably freaked when they figured out the motor in the 335i is an all-new turbo job, twin-turbo at that, that plus the fact that it's BRAND new and they probably felt over-exposed.. henced want to back out and not cover it.

So what's the excuse they're giving you?
