Correct, he initially agreed to paying for the wheels to be repaired, however, the bill was to high for him to stomach. He admits damaging the wheels, but won't pay for restoration. I am going to small claims for the entire invoice price of the wheels, since he's being a child. I'll take a brand new set.

I went through the same kinda stuff with Midas and lost the case, as well as about $500+ in damaged goods. Although your case is a little better than mine, don't assume you'll win. The ruling is at the mercy of the Judge, who probably has no practical/technical knowledge of mounting tires or anything in that nature.

When you get to the court on your court date, immediately before trial you'll have a chance to settle the case with the other party without Judge being present. Settle it right then if you can, unless you can bet your Mother's life that you'll win. Again, Judges don't have common sense in these types of stuff, so try presenting your case to a 12 year-old girl to test how convincing it is.

At the end of the day, lessons will be learned, and perhaps justice will be served. But regardless of the result, you may realize that your time wasted is not worth trying to save a few bucks on important matters such as your car, let alone losing the case. (Whenever I pass by Midas, somehow diarrhea still comes out of my mouth.) Not saying you should go to the best shop ever and/or waste mindless amounts of money; just go somewhere professional, such as BMW service centers, well-known race shops, etc.

He relented and apologized. The wheels were completely paid for in full by their insurance company.

Congratulations!

I had a similar problem many years ago. The guy damaged 3 of my 4 wheels mounting a set of PS2's. I pointed out the damage before he got the car off the rack! He refused to do anything. I took him to small claims court and won but it was a big hassle.

This ordeal taught me to always take pictures of my wheels before going to a shop to mount new tires. RFT's make damage more likely because the sidewalls are so stiff.
