got clipped in a lane change... and the police says its my fault..

a car in front of me, me, and the idiot behind me were all lane changing with signals doing about 10 mph... as me and the guy in front started to change lanes the guy behind me changed lanes quickly and decided to pull up just far enough for me to have no room.... and he clips me. the police says based on the damage i was doing an improper lane change...
fuck me...

The police cant put ANYONE at fault, unless the specifically see it. If they write that in their report, then i would go into the stationhouse and ask to speak to the highway safety officer. They can only write in their story that VEHICLE 1 states that....and VEHICLE 2 states that...

i agree with smoothy, im sure the report says....vehicle 1 states....vehicle 2 states....etc. hes a cop, not an insurance appraiser, he doesnt know shit about the damage based on the body of the vehicle. i'd bird him but i dun want to spend the night behind bars...

no... the police can determine who is at fault based on the damage + stories... i got hit on the side of my bumper on the passanger side... all paint damage...

Your mistake was admitting to not signaling while changing lanes. You should have lied about that vehemently. It also sounds like you clipped him if he got into the other lane before you. Regardless, your best bet would probably be to try to settle this whole thing without getting insurance involved as that will probably cost you a lot more in the long run if the damages aren't too bad. How was the guy in back of you supposed to know that you were changing lanes? I think I was your fault, sorry about that and sorry about the damages, but you must have chaned lanes into him and he had no idea you were coming over till it was too late.

you guys need to read my initial post... there were about 5 cars all signaling including mine. all 4 - 5 cars were moving over to the on ramp and as i was already starting to lane change with the car in front of me the car behind me decided to change lanes faster and move up forward so i could not clear his front bumper by like 1 foot. we were all doing 10 mph and nearly all 5 cars that were in a line were changing lanes to enter the freeway.

Oh my bad. On first reading I thought NO ONE used signals. In that case the guy behind you is a complete d-bag. I thought if you get hit from the rear it's automatically the other guys fault?

well if he hit the actual rear part of my bumper it would be but technically he doesnt have to let me in... so even if he does a quicker lane change while i am doing my change and he decides to move up a couple feet so i have no room (car in front of me is already right in front of me) i have no choice but to stop my lane change because i have no room... but i couldnt see that he pulled up a little further because normal in a such a slow ass lane change when a whole like of cars is trying to get on the freeway everyone just gets in a line and everyone files in neatly... so yes technically i hit him...

I see you've edited the original post, I guess you took out the the "without" signals?

You still should have looked harder before you changed lanes though, idiots come up fast from behind to get ahead of everybody and don't care about the car in front. He was dick, but you still should have looked harder, cause people do it all the time

did this happen at the highway ramp where two lanes merge into one?
regardless of who's at fault, you should never ADMIT your fault. leave it ambiguous at the scean because once you admit it was your fault, it will more likely be on police report... it sounds like it was very situational case but i don't know how exactly this happened and where the officer was so...

it was on ne 8th going into the south bound 405 round about on ramp... its not like it was some one rushing from the back to get in front... the guy was right behind me and 4-5 cars were all lane changing together in a line to get into the freeway lane. the guy was right behind me doing the same speed and signaling... he just pulled over twice as fast and pulled forward a couple feet so i had no room. normal people change lanes in a line and give front people room... i guess i should never assume...

i didnt admit to anything... the police came and said based on the damage i contacted him. officer was no where... she was called in.

damage can not be buffed... bumper needs to be resprayed + i need a new wheel cause its chipped and rashed to hell.

if that's the case and you really believe that you are not at fault, you can talk to calim officer at your insurance and go from there. the driver behind you must keep the safe distance from the vehicle in front. i'm not an insurance agent nor lawyer but it sounds like you have decent shot at it at least... officer might've just assume it's your fault because you are young and driving bmw... it happened to me before when i drove s2000, i was only 21 back then... damn discrimination ftl...
