had a wreck i have a question about it

ok on a friday night, i had a wreck, it was not my fault, person failed to yield, and cut me off from the far left to the far right lane, in which i was, and i hit him going 60mph.
now there is almost 10K in damage, car has 62K miles on it and insurance decided to fix it.
can i pursue them to total it or just let them fix it

if it has frame damages and it impacted your wheel allignment, your better off getting it totaled.

it does not have a frame damage, but front wheel alignment is a mess, they said that is a big chunk of the damage

yea i stated earlier that your better off claiming it total because if your somewhat OCD like me and many others, whether they admit it or not, you probably wont enjoy driving your car as much you use too. if ya'll know what i mean.

you see i mentioned that, then they told me that i need to go to the dealership and have it in written saying that value will go down and for how much , he said i should let them fix it then fax those papers to them after

Never believe the insurance adjuster handling your claim. Do your research. I found a 3rd party certified auto appraiser to audit my car for diminishing value. It'll probably cost you near $500 for it. The insurance is suppose to then reimburse that fee, on top of the diminishing value settlement.

Remember, they're not there to 'help' you, their job is to offer as minimal amount of payout to you as possible, to save the company $$$$... even if that involves manipulating your thoughts. It's their job... know that, and use this against them.

its funny you guys think that you cant replace a frame rail, replace some suspension components and it NOT go into alignment perfectly.


you obviously dont understand how frame rails and components like them are replaced. they are jigged and held within VERY close tolerances.


as long as the body shop is GOOD (and i know of only 2-3 that are worth their salt) then no worries.

Do you have a dealer with a body shop near you? You could have them estimate diminished value and/or repair the car.

Well car right now is located at the classic BMW collision center. Ofocurse after I asked adjuster about totaling it, he said they use new oem parts and it shouldn't affect the value. I then asked what about carfax and if he would buy it for a full price, then he changed his story.

I was in a car accident and I tried to get the diminished value which the insurance company has to send you the paper work for, but you have to ask for it. Even your insurance company will try to BS you as well and they do not like to talk about it. When I went to trade the car, I was upside-down for about 8K and my accident wasn't even that bad, about 2500 to fix, your is serious.

The insurance companies are full of it, they will try to deter you from it, but do not, stay on there ass. Remember you have to go after the individuals insurance that hit you. Again, they will try to BS you around.

They are liers, they are trying to get the business!. Yes it will effect the car price and they do not use OEM parts. They will use parts that equal to OEM, but not OEM. I was lucky when they were looking for the same quality as OEM, but weren't able to find any, so they had to buy OEM from my bumper.

yeah i am hoping if i get the diminished value taken care of they might even total it..
i am not fan of driving a car which was in such a big wreck

I don't know how much the damaged vehicle is worth as a sale or salvage but there is a chance you could end up with more money by taking the Insurance claim money and then selling the damaged car then you would if you were to sell the car as it was before the damage. My mom was able to sell a damaged Cadillac as salvage when insurance DID NOT total the car, and collected on the claim. She made $3K more doing that then she could have sold the car for before the accident and any diminished value...
