Does this doc mean that it has been approved and active?

That sucks, I was really hoping for the 8yr/82000 mile turbo warranty.

I think that is what was agreed to reading page 3 paragraph 2. I guess I should just call the dealer and find out.

They should have added the water pump to this lawsuit- dealer charges $1300 bucks + tax to replace it. Mine failed at 65k miles.

that is how i interpret it as well unless they are referring to that odd cali emissions only law. I think the additional 1 year was because of the time that has elapsed since the 8 yr/82k was proposed/accepted by the court.. w/e (not a lawyer)

I called BMW NA and of course they claim to have no idea what I am talking about, and couldn't see any extended warranty for the turbos on my car. The mystery continues...

The wastegates 'should be' covered through 8 yrs/82k mi according to the settlement agreement. A phone call to Class Counsel should clear this up.

Dude...I just read this whole thread and im fkn excited!!

I just bought a non CPO 33k miles 09' 335i M-Sport with the sole intention to mod the hell out of this thing. **turbo replacement** planned for 48k if i can swing it somehow. This wastegate issue is working towards my advantage here.

I know well of the HPFP warranty extension, but this is exciting man has anyone confirmed the warranty extension on the snails yet?

BMW does not give a damn about wastegate rattle. If there is enough boost loss they can be strong-armed into warranty service.

In my experience, if you are under warranty and take it in for the rattle, they will give you brand new turbos if it's very noticeable as a courtesy. If you are out of warranty and you take it in for the rattle, they *may* replace them ONLY if they find out that in addition to the rattle, the turbos are also not performing well. They will never adjust the actuators or replace just the wastegates. Their procedure is to replace all turbo components.

I was lucky since my car is 5.5 years old with no extended warranty, and I took it in for the wastegate rattle issue. I got a call the next day saying I'll get brand new turbos for free since the old ones were "sufficiently deteriorated". YMMV, but some dealers do know about the extended warranty on the turbos and it doesn't hurt to ask.

I actually told the dealership about the rattle and they didn't document it when I had my car in for fuel bank failure. At the time I didn't know and should have pushed for a replacement then, but now I'm on CP and they are telling me I have to put 2k up front just incase they are not out of spec and can be adjusted. If they are out of spec then they would cover them under CP at no out of pocket. I called back today because my SA is out on vacation and talked with someone from warranty who is also an SA and he's looking into it. He said if he can't get a clear answer than he would give me the number for BMW NA to plea my case for replacement. He said with the fact that I told the dealership about the issue while I was under warrantee and the fact that I have CP, they would more than likely just approve it so I don't have an out of pocket. As for the Class Action, he wasn't aware of and didn't show any extended on the waste gates or turbos. Only the HPFP.

Your dealer might know but may just give you corporate speak since it sounds like BMWNA isn't saying anything yet. Like I said, give Class Counsel a call. I tossed my Class Settlement statement, so I don't have their 411. I know they're a firm in Sacramento, CA.
In CA, the 1 yr/1200 mi extended warranty is in addition to the 7 yr/70k mi emissions warranty, so 8 yr/82k mi. I don't know if that's true for all States.

^ Regardless, even if they just slap the turbos on the 7/70 emissions warranty minus the additional CA 1/1200 extension for other states...that's win enough for me.

Knowing my turbos would be under warranty until 70k or 82k would be a load off my brain when I start getting into the 50k's. IIRC its like a $8k job to replace both.

I need to find this out. I am also assuming all 54's in the class are covered, not just original owners. I would assume this would transfer just like the regular warranty/maint.

have them or did they document your visit? Have proof that there is noise and they said its typical sounds. Seek another opinion (dealer).

My SA is very good, they said and I "" "Why do we care about recalls, it gives us work and keeps us busy"

I have all my recalls done with no questions asked. (no issue with Turbo or wastegates, knock on wood) Just be specific and show them, if you say i have a rattle, they take it in, can't mimic it, then you got nothing.

OUCH! I know a guy who's E90 335 went out on 52k (last weekend), CPO took care of it though.
