That dealer is just ripping you off. They just want to be parts changers. They are betting right now if they get the job who goes to the steakhouse! It is probably just the clutch master and possibly the pedal linkage and nothing else.

It's also easy to destroy a clutch within 7k miles, not saying the OP did, but it would be near impossible to prove otherwise.

OP - just keep hassling the dealer and the BMW NA. Most likely they will agree to cover labor if you pay for the parts. But at the same time you will ruin your relationship with your SA. Either way good luck.
I would disagree - the hydraulics for the clutch are not "upkeep items", but the clutch disk itself is. There is no way to "maintain" the clutch master/slave cylinder or hydraulic line besides replacing them if they fail - which it appears that this is what the case is. BMW NA should step in and fix this for the OP.

So how do I know I wasn't sold a worn clutch or linkage/master Cylinder...When I was told It would not be covered under warranty from BMW of Edison, that's when I went ahead and called BMW NA. Before this happened, I called my SA In OK and told him the situation and then asked for BMW NAs number he tried to give me a BS 1800 number after he freaked out on the phone. So I Googled it and what do you know BMW NA is in NJ AND the number was NOT a 1800 number but a 202 area code which Is NJ.

I believe BMW will cover 1 clutch replacement free of charge as a good will repair or maintenance. Google or look it up on e90 post.

BMW NA said they can't assist with anything because I have the certified pre owned warranty not the new car warranty. Called a relative to go to the dealer in tulsa to figure this out (now they decide cooperate) the SA said my CPO warranty covers a lot so now I'm waiting on the list of parts needed to figure out what is covered and what isn't.

Is there another dealership in your area? Have it towed there. Explain to them that your clutch pedal is leaking fluid and you believe the master cylinder is defective. Let them take a look at it see what they say.

I am stuck with them!! Ask if I could pick the car up an dthey said they have the tranny out and it would take 8 hrs labor +whatever it took to take it apart to get the car back. Basically 1000$ to get the car back unfixed. Anyone who is in jersey stay away from this dealer. But as of now I'm looking at 2800 for the clutch linkage and master Cylinder labor added (I hope). Master Cylinder is being covered as 'goodwill' (Tha Fuck?) because I bxtched about the price. Anyway I have one concern still! Supposedly my flywheels been played and the bearing came out or something like that but they said I don't need a new one (I'm taking there word for it). So im stuck with fixing it there even tho I didn't give them the go ahead to fix the car but they simply asked for permission to 'tear down' the car to inspect other damages and now they are saying I told them to tear it down and fix it. Lol I'm not paying 5 grand. I will keep you guys updated hopefully doesn't reach past 2800.

Things are FINALLY starting to look up, just spoke with service manager and he did not want to do the work with out installing the flywheel so they are gonna cover the master Cylinder and the flywheel under CPO warranty.. He kept saying as 'Good will' which was kinda getting to me anyway. I'm basically just paying for the clutch the pedal and all the linkage..They are charging me 2800$ + tax which will end up at 2996$. Keep in mind this is the whole clutch assembly that they wanted to fix for 5000$!

How did I do here!? :

And thanks to everyone for the input! Wouldn't have known with out you guys!

I had my clutch go out at 27k miles and got it covered under warranty? Maybe since I was the original owner and under factory 4year 50k miles they did it with not much questions asked?

The girl who owned your car probably had some hillbilly white trash boyfriend who played Mario Andretti in your BMW.

Clutch drops, 7k rev downshifts, etc. Woo-hooo!!

BMW and their dealer service departments are ruthless when it comes to clutch work and rear ends. No mercy. They know full well that a car with 35,000 miles and a blown up tranny has been beat to death.
