It will be the breather pipe that has been cut away due to the poor design which is causing the deisel to leak when you fill the tank fully.

You won't be able to fix this yourself by putting in a smaller pipe inside as the breather pipe is connected at both ends, one to the tank and the other to the filler neck. Putting in a pipe inside the breather pipe will not give you the seal at both ends and deisel will still leak when you fully fill the tank.

Look at my photos on the very first post for the exact problem.

Unfortunatley you are just another case of this issue and I would advise you get in touch with BMW UK, argue your point and get them to pay towards the repair and also get in touch with VOSA and file a defect report. By now VOSA must have many complaints so they must have to react to this.

No warning lights or anything here on cars in the UK, but you are from the US?

In the US the law is different where your car must show any leaks of fuel on the dash, so if you suffer from this issue, you are more likely to get a positive response from BMW about getting fixing this.

Hi - just discovered this issue on my '55 330i SE Touring. BMW dealer quoted £800 to replace (having charged £135 to 'diagnose'). Obviously highly reluctant to pay this, though with my little boy usually sat just above the leak I feel I shoul get it sorted, slim though the risk should be (if I don't max the tank at least).

Anyway, called BMW UK Customer Services and they said it was up to the dealer to propose a good will gesture, which as I didn't buy the car from them and in fact this is the 1st time I have used them for anything I find it highly unlikely they will do. The dealer themselves said good will was highly unlikely as the car was too old (6 years now).

So, I could take it to an indy for a quote and maybe 'only' spend £400 to fix.

Or I pursue it further with BMW UK - does anyone have any suggestions on who to call / email / write to for this as I don't think I'll get any success with their regular call line?

Thanks for any help, would be nice to get it sorted.

Hi Everyone,

Sorry to bring this one up again but I filled up my 330d last night and came down to a puddle of diesel on the ground. Took it down to the local BMW dealer who rang me about a hour ago with the good news, breather pipe leaking when it's full and it's gonna cost about £700 for them to fix. I said to go ahead with the work and have just sat down at the computer and come across this forum!

Just wondering if like a few others if it might be possible to claim something back from BMW on this? And who to call? My car's 2005, I've had it about 3 year and bought it privately. I've only used the local dealer once before so can't see them extending me any good will!

You can change the law by smoking cigarettes right beside it. By then, I sure they will change the law immediately

Just seen your note.

The only way you would get anything back from BMW is to have the dealer submit a claim first and then BMW UK will come back with a gesture of good will. I am guessing the work has been completed and you paid the whole bill?

On the off chance, call BMW UK, ask for the Customer Service Manager and explain the situation. You never know, you may get something...

Also, submit a defect report to VOSA, it may strengthen your case.

Thanks for your reply Zippy, unfortunately I did pay the bill, feel pretty hard done by paying £700 to fit a £40 part. I have emailled BMW uk but will see if I can get someone on the phone! Thanks again!

I'm having the same problem with my 320i. I've contacted my local BMW dealership to get their statement in this matter.
Strangely I get no results when searching for this issue in danish. I cannot be the only dane with this problem. E90's have sold plenty in DK...

BMW Denmark denies to know anything about this problem... No matter what their central warehouse has more than a 1000 of each item(the to numbers metioned elsewhere in this thread) in stock. Which is highly unusual if not it was subject to replacement.
3 years ago when I found out that I had rust in the boot lid of the E90 they also rejected my claim. I love my BMWs but the struggle with the dealers/importer in Denmark is awful.
Anyway I live very close to highly respected BMW specialist who has promissed to solve the issue. He qouted me 150€ for the entire job, and has done it as recently as today on another 320i. The 150€ includes parts and labour.
His workshop is offently occupied by foreign M3s and M5s. (Usually Norwegians and Swiss cars...) The local official BMW workshop always passes on cars to my specialist when they can't solve the problem themselves. (That's how I found him )

I know this is a long shot as the thread is very old but it might be worth a shot.


Firstly, has anyone had any luck with BMW fixing this free of charge due to the safety of the problem?

Secondly, has anyone tried sleeving the fouled section with thick heat shrink/shrink wrap or thicker tube with jubilee clips to stop the leak, and then put convoluted tube over the top to prevent any further chaffing?

Mine does it too. I'm going to fit the protective sleeve and try to fill the gap between it and the old pipe with some kind of expending foam or some other kind of sealant. A bit of investigation required.......

I finally fixed my leak.
I followed some instructions from another forum to remove the fuel tank & when I got it apart, I found that the spigot where the breather hose enters the tank had broken out of the tank!
I was able to get this plastic welded, then refitted the tank & have had no further issues

Now my E92 is leaking too. Where did you say this "highly respected" DK is ?

In the top picture what is that black tube going under the car to the right of the shock? I’m so confused and no I’m not talking about the fuel hose.
