Pot hole death

[posted this in the CA forum, but figured the rest of you may get a kick out of this]

So while letting the wife drive (first mistake, I know) the 335 to LAX, she hit an epic pothole at 75mph, completely destroying my front right forgestar F14 and damaging the rear right and both tires (see photos). As anyone can see the front tire doesn't hold any air and these are not runflats. Amazingly enough she drove the whole two hours worth from LAX like this with no air in the tire (she doesn't know any better apparently). I think this probably speaks for how quality of a tire the Michelin Super Sports are.

Anyways... I was hoping there might be a charitable member in the socal area that might be willing to loan me their extra set of wheels and tires until I can get replacements from forgestar. I'd figure out some sort of collateral if necessary. I'm not picky by any means, so long as they roll. We've got two jobs and now only one vehicle =/

Has anyone had any success with claims against the state for potholes? She didn't bother to stop and photograph it, or even remember exactly where it was. I'm thinking discount tire may replace the tires under the road hazard warranty. Am I SOL?

Damn, that's terrible. Seeing as how she hit an "object" in the road, could this somehow be claimed under your insurance as a comp claim?

I thought the potholes were bad here, but that damage is epic. Are you sure it was even a pothole, and not possibly something laying in the road? (looking at the pics on my phone, hard to tell).

As far as fighting the city over pothole damage, you can certainly try, but here in Dallas at least it is virtually impossible. The exact pothole has to have been reported (in some cases YOU yourself have had to report it), and the city given adequate time to repair it and then be able to be proven negligent in the repair or lack thereof before they will take a claim. That's why I purchased wheel and tire warranty/insurance when I bought my car.

I've heard that it's a little bit easier here to get compensated for it. I'd also imagine my insurance would pick it up but I don't know which route I should pursue first. I don't want to use my insurance if I don't need to but the state process takes up to 45 days. I can't exactly replace the wheels at autozone either =/

I wasn't there when she did it. She claims it was a pothole, but I'm starting to think she hit something that was laying in the road with the way that wheel is torn up. Women... She's ok at least.

I think he could only claim these in insurance if they were under his policy as a mod, otherwise they have to be OEM wheels, I could be wrong anyone else ever attempt to claim wheels might want to chime in?

Also yes, if you have road hazard warranty they would replace the tires.

Wheel-tire damage doesnt come under comprehensive.
this will be covered under collision.

you would also like to get the suspension part checked for any kind of damage.
you dont want to get surprised later.

I insure with USAA and I've discussed the idea of aftermarket modifications with them previously. Supposedly they would replace them so long as the total cost of my modifications don't exceed $5000 in a total loss, but I guess we're not talking about a total loss here. There looks to be some oil that leaked from the front right shock, too. This blows...

That does look like pothole damage though I did that to m3 replica wheels, which btw if interest 2 wheels curb rash, 1 slightly bent but holds air, 1 mint they are 19's w/ TPMS, they are great to have as an extra set of wheels for cases like this, PM if interested i'll send you some pic's

Wow... thats really bad. FWIW I didn't have any problems getting discount tire to replace one of my potenza RFTs when it developed sidewall bubble/damage from an impact. If you bought their road hazard certificates its worth a shot.

It would be a collision claim if you claim it. I bent a wheel in a pothole a month ago, had it fixed. I hate the term 'epic', it sounds ridiculous.

I've made a claim with Seattle about pothole damage. You must take a photo of the pothole, state that is was near a particular exit, and photo of the damage it caused.

My rim that got damaged in the process was only valued at $225, but the state reimbursed me $600 to account for a replacement tire, labor, wage loss (as if i was going to/from work that day), and a couple other things. They're very specific about what you can/can't claim though.
Not sure about california's claims though... good luck!
