Wait wait wait, let me get this straight. They are telling you the warranty started in 2006, when the car was built, and thus ended in 2010? And per the central database that the dealership accesses, your car's VIN says its in-service date was 10/14/2008 (meaning the first day it was sold to its first owner)?

So based on this logic, let me pose a hypothetical situation: If a dealership orders a new model year car from Germany, and it arrives and sits on the lot for a year and a half before being sold, the dealership can only offer the remaining two and a half years of the 4-year/50k new car warranty to its first owner?! That's ridiculous.

Again, unless you're not telling us something (or you don't know something) about the history of this car, I would be pressing this point until I was blue in the face. It may be the difference between $5-15K, and free.

OP, time to get a lawyer. In service date is 2008, when they had the car they should have fixed everything under warranty. Get a lawyer then post an update (when the case is over). Open the yellow pages there are 1000000s of lawyers out there. Consultations are free and bring in your paper work.

It doesn't make sense to me either he just plowed about 1200.00 into the car and all he got out of it was an oil change on an exploded engine. How did they charge 810 for diagnostics generally diagnostic is a flat charge never paid more than 165 regardless of how long it takes to find the problem.

The dealership is shady.

Another reason to get an attorney involved. Maybe OP is scared of attorneys? . An attorney might get Bmw to pay attorney fees. Unless, he is hiding a very important fact.

They didn't do a simple diagnosis. They did a partial engine teardown.

Whats funny about this? 2007 model year showed up in 2006 and punched when sold in 2006 so warranty starts in 2006....

I had both my turbos ripped out for 165.00 diagnostics. I'd say that's not simple diagnostics. I'll say again, I've never paid more than 165 for diagnostic regardless of the type of damage.

Make sure you tell them your paper work states the cars first in service date was oct 2008.

I am almost thinking your car was a demo car or a loaner.

Don't trust too easy. I had a dealer in Illinois write down that they performed certain work and charged me over $600. I took the car home and inspected their work to find out that they did NOTHING. Got my money back after threatening to sue and inform the Attorney General's office of their fraud.

That being said. They are the ones who wrote the in-service date on BOTH your invoices as 2008. They also told you that you can have it fixed later (when your warranty expires so they can charge you for repairs when you return). The burden is on them to PROVIDE with the paperwork showing you an in-service date BEFORE 2008. If they don't provide it to you then I say they lied to you and hire an attorney.

You can have your attorney write them a letter demanding that they repair the car otherwise you will have it repaired and sue them for damages. Your attorney can give them a certain time to respond (15 days?) so you are not waiting forever and you can take steps to have your car fixed.

Naturally, the choice is yours, but keep in mind, dealers are know as "stealers" for a reason.
