He did not ask for the upgrade, therefore he should not pay.

All anyone has to do, to get 32.1 is complain about Turbo Lag...

Call the dealer, ask for the service manager... be polite, tell him the list of what went wrong, and if he does his job, he will make them right.

When my HPFP died, it was on backorder, and my car sat at the dealer for 6 weeks... one call to the service manager and I got 2 months of my payment paid, a free OEM aero lip painted and installed (because he asked "is there anything else I can do to help this sit better with you", so I asked for the aero lip ). He gave many appologies, and made sure I was still able to rate them 5 stars on service, even though the expirience was not the best, they did everything in there power to compensate me, and then some.

If the service manager won't pay for the ipod and refund the update fee, complain to BMWNA and find a new dealer.

someone else had posted a long while back with a similar situation -- fuel pump failed with dinan, but not without it. Probably a marginal HPFP in my opinion. I don't recall how that turned out, but it sounds similar.

If the fuel pump is truly an issue, from what I've read you won't have to wait long for evidence without the dinan sw installed. It sux to have to deal with BMW multiple times for a known issue....

If you get no joy, give them all ones on the survey (if you ever get the survey) and find a new dealer.

I did not pay for my software update and I even asked for it. I did not claim to have any issues, I just want to be upgraded to the lastest verision.

They also replaced an injector when I though I was have my second fuel pump failing.

All for free though.

I don't know how you didn't turn right around and demand to speak with the service manager about the ipod being gone, much less the rest of the BS.

That's bullshit man...
I paid $380 for it. I had enough with the crapy 29.x and just wanted to get it removed. They said BMW said only if the car had a problem. F'it wait F'BMW I said I'll pay. $380 not the end of the world.

Wait until other manufacturers comeout with cars with twin turbos and close enough characteristics, BMW will eventually pay for for their behaviour.

I believe an upgrade is only free if you have a DME80 car. DME81 cars theoretically don't have turbo lag, therefore, asking for an upgrade will cost you.

Even if you did ask for updated software, he shouldn't have actually done the work without letting you know how much it was to be able to do it at your request. Basically how it works, if you request it, then yes, you pay for it, but he should have given you an estimate either way. But you should have just complained about turbo lag, and they would have updated the software under warranty. I'm a SA I know.. About the HPFP, if it passes the test plan, then no new pump, just how it works.

My first pump passed the test but threw the 2FBF code. They replaced it a week later when it was doing the same thing.

I don't really wanna reflash it again if it's just going to throw the damn fuel pump code. In fact, after a cold start I had a longer crank, which I thought was the warning sign.

Second thing is that they charged me $240 saying that I requested the upgrade my software. Requested? I requested they not mess with the software... Does anyone think I can get that money back?

And then, to top it off, when I got in the car, my iPod nano, old one, that I always leave plugged into the USB was gone. A technician stole my iPod! Seriously? What kind of service is that.

So, can I demand a new fuel pump under warranty? I'm attaching a list of codes that were reported, from the diagnostic tool, as well as the invoice. This is really starting to piss me off.

Invoice

Dinan is suppose to pay for putting the car back to stock which means the car is reflashed back to stock and then they try to reproduce the problem. I would call Dinan and let them know what has happened and let them fix this.

Your out more that the software install beacuse they didn't put he Dinan software back in.

You shouldnt even have left the dealership. I would have called the police about the ipod and I bet the SA would have did something real quick. And you should have never paid the $240 especially since you asked to NOT have the update.

I had a good sales experience with northwest but ive never been to the service department. I plan on using tischer.

Why does your invoice say "335ci"? What does the "c" stand for?

Hey, where's ybbiz34? I'll chime in for him:

"It is not Dinan's fault. Steve Dinan is god. You must have messed up. Dinan is never wrong and their software is perfect and would never cause a problem."

That said, you really should talk to the service manager. Getting charged after the fact, without prior authorization, is a big no-no.

Sorry to hear they are putting the screws to you and then lifting your ipod as a bonus. I agree with the "did service without authorization or estimate" approach. If they find something or are goind to do any work that would cost you anythin, they are supposed to check BEFORE they do the work. Especially if it isnt a life or death fix for the car.
I have a question about your invoice and the "Diagnosis Report", is that something they give you or did your specificaslly request it? I have never gotten one of those but would like to. I have a hard time even getting the alignment printout from my dealer.
