Thank god you're ok. It's so sad because you were just trying to break up the fight and you end up in the hospital. You are a very forgiving guy by not wanting to send him to prison. Personally, I would send his ass to prison. If he thinks he's so tough, prison will straighten him out.

So far, him/his lawyer have declined all plea deals and plan to fight the charge. His defense at the prelim was. "It was not me". He was actually on probation for felony drug charges(at the time of the incident), so either way, if he accepts the plea he is gone on both charges.

Also, to this day he or his family has yet to have any sort of remorse. The video clearly shows him, so I can't logically see why he is denying it. I offered the plea deal only on the circumstances; he man up and admit, take the rehab courses, pay med bills, and do < time than the max.

This kid sounds like a real a-hole. Why on earth do you want to give him any leniency?

Whoa, now I'm even more surprised that you tried to work with him.

No remorse, repeat offender, tried to actually take your life... You are good for what you're trying to do in working with him, and I'm not trying to change your mind, but do you believe he can recover to be a productive member of society after all you've seen? Do you worry at all that once he gets out early as a result of your working with him, it's possible he'll go ahead and actually kill someone?

WOW!!! Morgantown is violent place! I was just searching for the news story on the internatives and found a whole slough of stabbings, slicings, murders, malicious woundings, etc.

There are some blade carrying mofos in them mountains. You are lucky you are alive...hell, you will be lucky to make it out alive if you continue working there. Good Luck and glad you are fine!

That is my only worry. If he were to hurt someone else after his time/plea is up, it would be hard for me to live down. I had initially thought, "anyone can change". However, that change must be promoted from responsibility and time.

I am actually not a huge fan of the justice system the way it is now, but regardless I try to bide by it. Some people just never learn.

If we had Hammurabi's, "an eye for an eye" he might change his mind. But until then, I think alot of criminals are lost in the sense(they will never learn their own lesson).

Glad you are ok.

However, I told the prosecutor if the kid agreed to pay for medical bills (~40k), take anger management, and rehabilitation courses, I would not push the sentencing.

I believe in second chances, but only if he is willing to take responsibility and gradually progress towards being more responsible and mature. He will likely spend less than 2 years, assuming he takes the plea.

Has this punk shown any remorse for what he did? I'm not so sure that I would be willing to let him plea bargain to a lesser sentence.

It's great to hear your ok and your spirit seems to be intact. Never fails...the people that break up fights are usually the one who catches the blow. His charge seems to be light considering where you cut. The other guy in the altercation needs to be thanking you.

F... this kid. He showed no remorse and is not admitting to the act even after video. I'm glad you're ok but tell your lawyer to change the charge to attempted murder and send him up for twenty years. You sound like you have a good heart and you've given this kid more then enough opportunities to man up, but he hasn't. So f... him.

Not at all! Idk if he cut nerves, or if my adrenaline was pumping that much, but I didn't feel any pain.

I guess if you are sure your dying, you forget about everything except the things that matter the most. The 5 or so minutes i spent waiting on the ambulance seemed like an eternity though.

I didn't call any of my family members until after surgery. I didn't want them rushing 5hrs and to see when the inevitable was going to happen regardless. However, I did let the surgeon know to tell them I love em before I went under.

For those of you all who don't personally know me;
I am 25 and teach freshman calculus/ low level math at WVU. I graduated from UVA in 2010, and took a teaching job in Morgantown, WV immediately after graduation. After about three months in Morgantown, I had made alot of friends and was fitting in with the new WV "culture" fairly well, until June 27, 2011.

It was the end of summer-1 and finals week at WVU, so after grading hundreds of exams I ventured out to have some drinks with some departmental members. After watching some college baseball and finishing a few beers, the departmental members and I decided to head back to the office. We then walked out of the sports bar and immediately saw two kids fighting/shoving. Hence, holding our status as "teachers" we felt obligated to break it up. I jump in between the two guys and one scurries away frantically. Next, I proceeded to ask the remaining kid what happened? As soon as I open my mouth, I catch a light shove from the individual.

And I am by no means a small guy, I actually look fairly intimidating. I took light notice of the shove and told the kid just to go home so no police report needs to be filed. The kid proceeded to take one step back (like he is walking away) and then took a swing at me and immediately ran off. Feeling no abrupt hit or pain, I turned around to walk back to the office with the staff. As I turn around I start to feet my shirt becoming wet, and thus sticking to me. I look down and I am standing in nothing but a puddle of red. I was wearing a white shirt, so you can imagine the state of shock I am in when I glace down.

At this point I really didn't feel any pain, but I could notice a very different feel on the left side of my neck. I then reach up to check my neck and my fingers literally feel my carotid artery.

Someone in the bar called 911 and i was rushed to the closest hospital. The individual had caught my throat with a box cutter, when I thought he was trying to punch me. My carotid artery (what takes blood to the brain) had been cut and my jugular had a 1mm gash in it. I was going in and out of consciousnesses while waiting on the ambulance. It was quite obviously I thought I was going to die, but had no control over it so I just continually prayed.

I was rushed to Ruby Memorial Hospital (West VA. University Hospital) where Dr. Lewis performed emergency surgery. It was a miracle... I woke up the next morning alive and well, no paralysis from the blood loss and no life threatening side effects.

Sorry to waste your time, just wanted to let everyone know how fragile life is and to enjoy and cherish ever minute of it.

This picture was before the accident and you can see my Carotid artery sticking out (pretty damn big artery). This was severed and I wont even get into how far blood is gushing/squirting.

That was a year ago, and the scar is barley visible today. The cut was dircetly in the crease of my neck so its hard to even tell I was cut, visually.
Glad you're still alive buddy. Sounds like it was a close call.

Couple of things: the prominent vein in your neck in that photo is your external jugular vein, not the carotid artery. The carotid artery and internal jugular vein are underneath your sternocleidomastoid muscle and don't generally have surface markings.

Secondly, although there is a chance that this may have been a carotid injury, it's unlikely. Generally, a carotid injury will result in exsanguination and death in a few minutes. Although blood spreading across your shirt is undoubtedly scary and dramatic, a carotid injury usually results in blood spraying in a pulsatile fashion 4-5 feet. Chances are this was an external jugular or, possibly, internal jugular vein injury. Much more survivable.

I second this
he's a rabid animal, and rabid animals deserve to be put down. Jail is too good for repeat offenders.

I'm glad you're ok OP, but this kid deserves to be put away in ass-pounding prison, not given a "second" (this is probably his 100th) chance.
Anyone who carries a weapon like that on probation is obviously deranged beyond salvation.. He won't learn from it and you can be your ass this isn't a second chance you're giving him to better himself, but maybe to go do it to someone else.
