Diesel leak from rear of car help?

I have this issue with my e92 335d.

Has anyone successfully got BMW to replace this as not fit for purpose?
I could do this work myself but wonder if I can get them to do it FOC as its unsafe.

Wow my post of 4 years ago and 3 cars ago is still going

Back when I had this problem 4 years ago in my old 3 Series I had my local indy replace it for £45 plus the part. They managed to tilt the tank without completely dropping it, so was literally done within the hour. They did it whilst I waited and showed me the old pipe.

We've seen a few of these with this problem,( labour wise about 2.5 to 3 hours as you have to move the tank slightly to cit)to do the problem really comes to light when the cars filled up with fuel the modified pipe work and sheaf that BMW now sells apparently is the answer and it seems to work from the ones we've done, but the problem for me lies around where the pipe work is routed and why it chafes in the first place.
