E93 AUC from UK dealer, now find its been in an accident

Hi All,

I was wondering if I could get some advice. I purchased an 07 320i SE from a BMW dealer in Sept 2013 and was told that the car had been checked and was accident free etc. Since purchase of the car I have had nothing but problems with the roof mechanism, in March this year the purchasing dealer replaced all the roof seals. However when I started using the roof properly I found the roof again would go down, but not come up. I have been taking the car to my local dealer since then who could not replicate the fault until last week where he found that the roof was twisted and he said that this was "due to accident damage, voiding your extended warranty" . Now I am absolutely furious with this, I am facing a £1800 bill for the roof to be repaired and left with a devalued car and useless warranty. I have also found the car now randomly loses drive at 40mph, so I have to press the ignition again to get it going, terrifying.

What are my rights here and what can I request?

if they lied to you about having a clear title then your probably within your rights to sue. contact a lawyer. as I am not one.

The part with losing drive might be related to the battery cable recall.

You have a breach of contract. Sold on the premise that it was Accident free and it wasn't. I'd demand a full refund on the grounds of breach of contract, and walk away from it.

EDIT: I've just seen the date of purchase: You probably won't be able to claim a full refund, but WILL be able to get it repaired under the same breach of contract
