Hello people,

My beloved car has had its rear end penetrated this afternoon
I was driving through an urban area and when I stopped at the lights as it had turned amber a nissan micra attempted to drive through my car
the driver of the car involved has claimed full responsibility and I have been to a bmw workshop and they have quoted the repair cost.

Now the question I want to ask you folks is, as you can see I have a rear carbon fibre diffuser, and I have not declared the mod to my insurer.
As the accident was not my fault is there anyway the guy involved in the accident's insurance company be able to wiggle their way out of not paying out because of my undeclared mod?

Also should I ask them to replace the undeclared diffuser?

Any advice will be greatly appreciated!

i cant see it why it will make your car more powerful,so i would tell bmw to quote the parts that is allready fitted so bumper that carbon thing and tail pipes and any other bits behind,

Gutted mate, just hope the Micra driver has insurance! Can't see how his insurance could worm out of repairing your undeclared mod.

thank god he had insurance... i think i would be waaaay more stressed out if he didnt. i got his insurance certificate number, witnesses numbers etc etc oh and his mum's number too

Am guessing but if the BMW repair centre specifically state the diffuser is not OEM then the perps insurers may try and use this as a get out clause for reduction in payout. That said the Micra driver (small brain as in micro obviously) is on a sticky wicket as he rammed you up the rear so to speak and is therefore at fault.

Really depends on how, if at all the others insurers try to reduce the costs your insurers are going to put it for acting on your behalf.

The only way to know for sure is to speak to someone with a comprehensive legal knowledge of this situation as there are too many variables.

Personally for a cosmetic mod I would like to believe that there wouldn't be too much of a problem but who knows how insurance companies think.

Someone else on here might know for sure.

If you can get two quotes from BMW bodyshops to complete the repair, including out-sourcing the carbon fibre section, then his insurance company should not even question it.

At the end of the day it his insurance company who will pick up the bill. The details of your policy are only relevant to your insurance cover... not his!!

2 weeks ago i had 1200 quis paint job done on the back of the RS4, 3 days after getting it back a taxui driver hit me and needed a new bumber and rear light. Just got it back today.

Oh No Thats crap news matey, hope you get it sorted swiftly.

As for the diffusor, tbh I know you should not be left worse off but I would be tempted to just remove it and keep quiet, maybe mention to the bodyshop that you want it including in the price but not officially (they might be able to 'lose' the extra cost of it in the price of the whole job?

Not worth having to navigate the small print of someones insurance policy for something relatively minor.

I think you'd only have a problem if the insurance companies decided to settle on a knock for knock basis. That's not going to happen here.

Unfortunately from past experience with my old E46 M3; when the insurance assesor comes and look at your car from the other side; they will only pay what is OEM BMW parts unless stipulated in your insurance. Sorry....

Indeed, most repairs are assessed before any go-ahead is given - either remotely or in person.

In this case I expect it'd be done remotely. I'm not sure about what the outcome will be; tricky one.

Every time I add something / mod I call up may insurance (Admiral) and they just add the modification on to my policy and send out a new one for free every time

Have had remus exhaust, new grills all round (none BMW), springs etc, all they charged was an extras £14.90 on my premium. The sake of £15.00 and a few phone calls surely it's worth it even for peace of mind and the small print!

Thank you for your kind words and sympathies! I am actually not that cut up about this situation as much as I thought I would be as long as it returns to its original state.

I am just glad that nobody was hurt, as someone could have easily started to cross the road and if they were I would have definitely hit them as my car was pushed passed the traffic lights. Having said that, I am not trying to get more out of this incident than what has been damaged but my neck does feel rather sore this morning.....

I am still not sure what to do about this undeclared diffuser situation as it will cost 400 pounds to replace..... also I did consider removing it just in case as a member suggested, but the carbon fibre has ripped all over and most of it is still firmly attached (glued) to the bumper, so its quite difficult to take it off without causing even more mess! Its sod's law really, as I was planning on declaring all my mods together when I eventually buy the remus sport to save the admin charge!

Also has someone done this process through a special service bmw offer where they take care of all the paperwork for you, come and pick up the damaged car and replace it with an equivalent bmw model? Apparently its 100% free of charge??

Oh and I got the quote last night from bmw for total repairs...... 3K!

If you are talking accident exchange, then yes. Car was taken in the next day, replacement 330d Touring supplied for the duration and all billed to the other party. Only down side was all the form filling and justification for the replacement car when the other insurers were trying to wriggle out of the costs (they price them at about £2k/week). Was looking like going to court, but that was just the other insurers stringing things out as long as possible. So in the end was all sorted in 50 weeks, and without my having to spend a single penny, or lift a finger other than fill in forms.

(Car itself was fixed in two weeks).
