workshop situation, help required

Hey guys, happy new year to all!

I'm in a bit of a situation with an workshop, all forms of neogatation havnt resolved anything, for obvious reasons I'm not going to say anything about it, however if any of you have been in a situation where a workshop hasn't done the right thing and had to pressure an alternate path to get it resolved then could you please PM me? Any advice would be greatly appreciated!

Hard to give advice without the full story, but a few years ago I had an issue with a Holden dealership and I went to the ACCC (as what they did contravened Australian Consumer Law) but they couldn't really help me.

I ended up writing (with the help of a legal secretary I know) to the Holden CEO pointing out all the clauses in the legislation that were broken and he assigned someone from the Holden head office to help me deal with the dealership, which ended up being resolved in my favour.

To help clarity A BIT, its with a Indy repair shop, a job was done a few months prior (more than 6 months) and now that part has failed as a result

The part failed?

That's a tough bet. If the part failed it's not their fault, unless they've deliberately cut corners and knowingly used parts that were "not fit for the purpose for which they were sold".


If I get a BMW water pump installed by my mechanic and 6 months later it cracks and leaks water... I can't blame the mechanic unless there is VERY solid evidence that they'd damaged it during installation or somehow been negligent in performing the work.

What about deformation against the workshop? And its not regarding any on this forum

A while ago I had a workshop tell me one of my parts wasn't replaced under BMW Warranty before (which it was, I have the receipt from the previous owner) and so I paid to get that part fixed. However like I said, after checking the receipts that were in the car myself after getting the car back (the car was at the shop and I asked the shop owner to check it for me, he said the receipt was not for that particular part)
The part was still under a 2 year BMW parts warranty so it should have been replaced for free but I ended up paying 1000$ for it.
I was pretty pissed off but I let it go and haven't taken my car to that shop since and have told everyone to not go there (you'd know if you were at the last meet haha) fuck them, I could've bought coils with that money (

Nah don't remove it.

That lid is notorious for not being closed properly. Mine wasn't closed properly when I bought the car.

Have you opened the box and had a look at what damage has been done?

Tough one. It comes down to if they closed the lid correctly on the dme box or not, and if they didn't, whether or not you can prove it.

I wouldn't really accept the whole drainage plug was clogged excuse. Even if the lid was closed correctly i can't really see how the clogged drain could introduce water into the dme. Once the lid is closed correctly its pretty tightly sealed.

I do know from personal experience that dme lid is a bitch to shut though.

I agree with ur middle statement and its what I'm thinking, as for proof, I've got it in writing from the people that I took it to?

Not enough proof, from my personal viewpoint. The first shop will simply argue that in the space of 6 months plenty of people may have had fiddled with the box and hence will basically wash their hands clean from the issue

If it was within 6 days or 6 weeks, for example, then that's a totally different story

It'd be worth having a chat with a solicitor as 3k is a rather large amount to pay out of pocket.. worth a shot

Come Monday, call up the ombudsman and have a chat with them. You have a 325, so i cant see why you would have the need to take off the cover.

They had the replace the computer few months ago, and to do that you need to take the cover off, it's housed in a white box with a white lid, same for all e9x
