If at the traffic lights and you have the gear in "P" but not the handbrake on, and someone rear ended you, isn't there will be more damage caused when compared with it in neutral and with handbrake on?

If you are in neutral without brake/hand brake, and some one rear ended you, you will hit the car in front or get shunted into the traffic.

The Automatic gearbox used in E90 has some new features, one i related to this tread:

Stationary Disconnection
The gearbox features a stationary disconnection (uncoupling) function for the torque converter.
The torque converter is disconnected from the drivetrain instead of running the
engine against the torque converter when the vehicle is stationary. By disconnecting the
torque converter with the vehicle stationary, the engine is subject to minimum load and
fuel consumption is reduced.
Disconnection (uncoupling) of the torque converter is achieved as a function of the
following signals:
Brake operated
Selector lever position D
Gear oil temperature > 20C and < 120C
No trailer signal applied

...having checked last night I was right in what I meant....so long as the car is moving you can knock the car from D to N and back without touching the brakes at all....

I only ever leave mine in park PMSL. Your saying a silly ickle pin holds it which is likely to break? never heard of that kind of failure before?
