Employment law - holiday

Hi,
my wife works in a restaurant\bar cleaning the cutlery, pots etc.

She's been there for 1 year.

For 50 hours work, she gets paid 300. Now I don't know anything about tax or NI, but should she get more? She's 36 yo.

We are about to go on holiday for 2 weeks and I believe her employer should give her holiday pay. She works 4 days a week. Tue-Fri. I know this will be a fight as he didnt even pay her when she was off work sick.

What is she legally entitled to? I believe only self employed workers are not entitled to holiday pay.

The law seems to say 4X5.6 = 22.4 days per annum.

I really need to ask for her employment contract without sounding like a c*nt but I feel they take advantage.

Hope you don't take this the wrong way, but is she legally employed? Does she get payslips and payment into her bank, or is it cash?

Doesn't sound too good here.

I'm not an expert, but the minimum wage is now 6.50. So she should be on a minimum of 325 per week for 50 hours. You've also got to sign an opt out to work that many hours.

Sick pay isn't always paid. She should get government statutory sick pay which is 87.55 per week.

Legally she is entitled to holiday pay too.

Sounds as if something is seriously wrong here.

You pay 20% income tax on any annual income more than £10,000

You pay 12% national insurance on any earnings over £153/week

You should also be legally paying a pension contributions at anything over £10,000 but I think that gets complicated quickly depending on your employment status.

So if her net pay(take home) is around £300, she's probably just at about minimal wage.....But her employer doesn't sound too nice/caring.
