I hate to bring this up, but I will be the first one posting some photos here documenting the problem I'm seeing since some other people have been drilling holes to make it fit.

As you can see here, the rectangular portion of the sheet metal fits into that groove with nothing hitting or in the way. The U groove fits perfectly.


Here is a view from the top, as you can see, the hole is not visible because it's misaligned:


Here is a view on the right side, the screw is screwed in and the the large U groove fits over the plastic.


so what now? Should I mod and drill like what I do on my Honda??!?

This is what I did to make it fit. Instead of drilling a new hole which would weaken the integrity of the mount, I cut out a small rectangular section of the sheet metal using a dremel tool as shown in the picture. Now the scoop moves forward and allow me to align the hole with the stock grommet hole. I don't imagine most BMW owners willing to do this because they expect perfect parts but this is what I had to do.
