went to pick up my 335i and it was sold??

Just vented my frustration.. 2 days ago I drove 200 miles away to pick up a CPO 2007 BMW 335i w/ approx 22k miles ($26k) from a BMW dealership in NJ. I negotiated most of everything via email and phone.. I asked about filling the paper work for financing out on a Friday and the salesman said "don't worry about since you'll be in when we open tomorrow".

So Saturday morning I go to get my new car.. I get there and the salesman is literally hiding from me. I then find out.. that someone put a deposit down in the late the night before.. So I'm like..

Argued and argued and argued.. they tried to find me another ride.. but they kept showing me other 335i's that were WAY overpriced. I wasted 6hrs of my time, approx 400 miles of driving and came home w/ nothing.. now the search continues for a 335i at a killer price (getting very close).

Oh.. I did place a complaint in w/ BMW corporate this morning about the whole ridiculous escapade.

That really does suck; but you should have put a deposit down with a credit card.

You never left a deposit from your end? Any faxed papers to sign and whatnot?

Roxbury BMW in NJ. I specifically asked the salesman if there was anything I needed to fill out etc.. etc.. he told me that since I was coming in the very next morning not to worry about it. I made the assumption "don't worry about it", meant he had placed the car on hold. I agreed to buy it for the price we negotiated.

Strangest thing was that I didn't see the car on the lot anywhere.. Granted it could have been in garage being cleaned for the person who supposedly bought it. But CPO cars are usually already prepared to be driven right off the lot.

car is still on their website too? They did technically only have Saturday and Monday to remove it though.. I'm curious whether they're just trying to bait people into their dealership..

I've had no luck w/ your local dealerships whatsoever.. I think they're a little more overpriced because of being so close to philly. Had the same problem went I got close to the Washington D.C area..

Yeah definitely a killer price. They were actually taking a loss on the car b/c they had it for so long. They owned the car for 26.8k or so. As for a deposit I definitely would've made one if they would've asked. When I was told not to worry about paperwork etc., until I arrived the next morning, I was under the impression the car was being "held" for me for the next 5 business hours or so.

I'm fighting right now for a CPO 08 335i w/ 20k miles for 28.5 or so. They're still $800 or so off.. I think I can get them to hit that price next week (could be gone then though).

It's not your car until you pay for it (technically). ALWAYS leave a deposit as you can always get that back but once they sell "your" car, you'll never see it again. If you found the exact car you want, you really shouldn't let $800 get in the way. That's a few dinners out with your chick. I held up the purchase of my house for more than a month for a difference of $1,000 but finally realized that I spent over $1,000 in rent just by delaying the process.

I woulda left that deposit in half a sec.. These deposits are almost refundable anyways (just used to show you're gonna show up w/in a day or so). I trusted a lazy salesman.. oh well. Not the #1 color I was looking for.. but definitely an amazing price. If anyone's curious it had Cold Weather, CPO'd and only 22k miles.. beat my best price so far by about 1k (after 3 months of searching).

I went to the Roxbury web site and saw your car. I noticed it did not have the Sport package (or navigation). That price was pretty good...but not great. Maybe you'll find one WITH the Sport package and be much happier in the end. Good luck!

I've dealt with some dealers that won't even take deposits... first come, first served. Someone beat you to it. Sucks but that's the reality of the business. Good luck with your search.

Well any number of things could have happen, they could have had seller's remorse, and realize they let it go for too little.

One time I had a sales guy screw up in my favor and then had the Sales Manager try backing out of the deal, he said it did not matter what the sales guy said, did or agree to or wrote down, unless his signature was on the deal it was not valid. It went back and forth and basically I told the sales manager he is going to honor the deal or I was going to bring a world of hurt down on him and the dealer, either way I was getting the deal form him or someone else and he was paying for it since small claims court usually favor the consumer.

You should have had them show you the contract for the car, since it could have been a bait and switch, you do not see that too often these days, but if they can not show you a contract then a nice visit to the AG officer will make their asses pucker.

I never believe salesman, they will say anything to get you inside and then try to sell you something else. Who knows someone might have put a deposit on that car a long time ago and when you arrive the salesman says, "Oh so sorry, but let me show you...." classic bait and switch.

Wow that sucks! I'm sorry to hear that man but I guess something at least shouldve been mentioned about a deposit. Hopefully you'll find a good car soon!
