What's up everyone...

About 2 years ago I placed a $1000 deposit on the e92 M3 at a dealership in my area. At the time I owned a 2001 e46 M3 and was anxiously awaiting the arrival of the next generation M. Since then a lot has changed... my 2001 M was out of it's warranty and I wanted something new that was a bit cheaper but not much of a compromise. After selling my M3 I purchased an e92 335i which I have had for about 6 months now. I still have the deposit on the e92 M3 which is $1000 towards this car and also guarentees me the 3rd e92 M3 that this particular dealer receives. I will not be looking to purchase this car when it comes out so I want to sell my spot in line. I have all of the paper work from the dealership along with a copy of the check I made out to BMW. This is a non-refundable deposit so the dealership cannot pass me up to give it to the next person who wants to pay more. I had my sales associate clearly label the paperwork that this will be the 3rd allocation of the next generation M3 at this dealership and that it will be sold for MSRP. I already spoke with my sales associate (who I purchased my e46 M3 and e92 335i from) about transferring the deposit into another name and he said this is not a problem. Keep in mind that this $1000 deposit will be $1000 towards the car at the time of purchase.

Since it appears that you are trying to turn a profit, this should be posted in the classifieds and not in the general forum.

well, let say you had put that same deposit twds a CD, savings, or Stock, What kind of % interest return would you get a year?

Now, how much you can charge the new buyer, 1k, 2k or 3k ?
So, how much % interest return did you get for your 1k? 100% 200% ....

So, as I said IF you can find that someone to give you that much for your spot it would be a good return.

You made a check out to BMW? BMW AG? Preorders are taken by dealers, not BMW or BMWNA. And, since you have not yet seen anything related to the future model, they are typically refundable. Ask for your money back if you don't want the car.

If you would like to know the specifics about who the check was made out to and the exact day I completed the transaction please PM me. The allocation is not refundable and I made sure of that at time of purchase. If it was refundable the dealership would easily be able to blow me aside by refunding my money at the time of purchase when the next person comes into the showroom and offers to pay 10K more than what I was going to pay.

Sorry if that sounded like an affront. Typically, from my experience, the deposit is only refundable at the buyer's request. The logic is that the buyer has not yet seen the final product and it may not meet his expectations. Obviously, dealers can play all sorts of game by slipping people into the list. You need to buy from a dealer you have faith in. My dealer, to my knowledge (bought my first 2002 from them in 1973), has never played these games. Even sold the Z8 at list.

I never understood those spot #1 or #3 people...and paying premium.
Looks like the BMW took good 6 months to fix the issues on every new model out there -- why would you buy a #1 car and go through that???
I think I will wait for the 2010/2011 model...

Exactly... Most states have laws about deposits. They are typically refundable for intangible objects (e.g. holding a "spot", not an actual car). They (dealer) will not be at a loss nor be put through any hardship as the car has not yet been released and the list of buyers will long once the car is released/ available. Good luck
