What type of issues would you think i may have with a rear end collision. The dealer said it was more like a fender bender (if you can trust his word).

no issues, i mean if there was no frame damage and it was just the bumper/tail lights replace its not a big deal. but you have to look at it both ways, would you rather spend the same amount of money on something better with a clean title or something with accident report. its going to suck when you try and resell the vehicle. just my opinion

For what it's worth, I manage a dealership in Indianapolis, Indiana. I deal with Carfax reports all day long. They can make a great sales tool for the dealer if they are clean. They can also make a great bargaining tool for the buyer if there is damage reported. As long as an accident is minor (as the Carfax you posted appears to be) then it honestly doesn't affect the value of the vehicle much- if at all. A car is only worth what someone is willing to pay for it.

As far as the accident on the report is concerned, I would be more concerned about the quality of repair. I have seen cars repaired by skilled body shops that literally looked brand new. I have seen others that looked like they were done in a barn over a case of beer. In the dark.

If the repair is good (all body panels line up properly, lamps aligned, paint is flawless with no "orange peel" or imperfections) then I wouldn't be concerned by the accident. If the car is not local for you, ask the dealer to send some very specific detailed pictures of the affected area. Any dealer worth his salt will do this for you.
Lastly, as I mentioned before, use it as a bargaining chip. He wants $22,900? Offer him $19,500. Let him counter you. If you stand your ground, and are actually prepared to walk away if you don't get the numbers you want, you might be surprised by the kind of deals you might get.
Good luck!

I would keep looking, both of them are going to be a headache in the future, in terms of resale.

Because of the storm that hit the east coast, I would be extremely wary of any cars being sold from that area. Or from any area for that matter. Water and electronics don't mix...

I wonder if Carfax shows flooding????

Judging by the picture that's the small car lot on Plano parkway, right? I recommend you not to buy it because I was there checking out a BSM e90 335 and over the phone the guy say its mint condition, clean, low miles, etc.. So I go in there and my gut instinct tells me somethings wrong so I ask for the carfax and the guys comes back out flipping through the carfax and said "oh yeah there's one accident" so with that being said I think you should take your time you'll eventually find one that's perfect for you because I did a month after in Houston and I love it, well good luck with your search

At that price point I wouldnt especially with the accident showing. Keep checking around on eBay, autotrader, carsforsale, and sites like that for similar deals.

That car is a definite ho-oar. I personally wouldn't chance it considering all the action it's been getting.

Why would someone bring a BMW that is still under warranty (I think) to service at a GM dealership?

Seems strange and would raise a question in my mind.

Some butt pirate panic stopped on the Interstate and I hit him ... hard. Consequences; hood destroyed, grill destroyed, headlamps cracked but functional, airbags 4 of 6 deployed, heat exchanger replaced (fin damage), and a few minor things I've forgotten. Total bill, over 15k.

So, let's assume his car was no worse than mine. Why would I buy it? Because, like me, he probably demanded OEM parts and, at least in my case, the vehicle was restored as new. Literally.

Not convinced? I wouldn't be unless I was shown the repair invoice. If he doesn't have one, he can get a copy and if he doesn't want to show you an invoice, then walk.

The real point I'm trying to make here is two-fold; the E90 is built like a tank and "accident damage" doesn't mean bad car. It can but you won't know without the repair invoice.
