Valve Cover Gasket only or possibly something else?

Today, I noticed a burning smell when I parked my 07 328xi e90 in the garage. Without popping the hood I noticed the burning smell was noticeable when I stuck my nose near the front passenger wheel well.

I then popped the hood and took a few pics of what I'm assuming is a bad valve cover gasket/bolts. The thing is that I didn't smell the smell nearly as much from the top as I did from the front passenger wheel well.

Doing some reading here it seems like bolts were in issue for the 2006 models as BMW over-torqued them at the factory. Was that an issue for any 2007 models? My car has a 10/06 in-service date. It looks like my car has the plastic valve cover (black?). In the first image you can see that it's dirty and grimy right where the cover meets the head. Is that a case of leaking oil or does it naturally get dirty? If it's that dirty from the oil I would think I'd be smelling it sooner. Currently the oil level is at max and an oil change was done about 2 to 3 months ago, so I don't think I'm losing much.

In the second image you can see where it looks like some fluid is splashing and hitting what appears to be a shield of some sort.

Could the smell be something else localized to the passenger front wheel well area? I did a front brake job about 4 months ago but rotors look good and brakes are stopping well.

Car has ~65k miles.

Read about the places to look in this thread so we dont have to type them all out again,

http://www.e90post.com/forums/showthread.php?t=774562

check to see if you have any oil on the side of the block.

Thanks for the reply but that thread doesn't answer my basic question:

What else could it cause the smell that is localized from the passenger wheel well? I have spent some time searching. I also posted the images of what I'm assuming is oil grime, and hoping my assumptions can be confirmed or rejected (hopefully rejected). Also, could a leaky gasket actually cause the drips shown in the second picture.

Sorry if this is a tired topic, but Ive done some searching and didn't see a clear answer.

Garage List
are you consuming oil? does CBS say you are losing oil?

I have symptoms of VCG leak but it could be other things, including a spill from an oil change. I'm not losing a noticeable amount of oil, so I cleaned everything up and I'm watching to see if more oil appears. So far, no.
