Op, where you present when your car was picked up? I would think a vehicle condition report, similar to that of a rental pick up is mandatory. I just can't understand how someone could return a vehicle in that condition.

Agreed! Even good companies can screw up, why pay for a no name to do it to you for sure.

Wow, this is unreal, I am sorry this happened to you.

If that were me though, and I only THOUGHT I had water damage because of what people told me, and the interior was dry like yours was, I would have had it towed to my dealership or a trusted independant mechanic. If they found that there was damage due to the storm, that's when I'd start with my insurance company.

This. I settled claims for a long time and i have heard of encompass but I have never heard or seen a claim handled like this. Seems very odd.

So to update. Insurance is sending a claim rep to evaluate the car. They have pictures of before all this wreckage, and they're sending it to me. So proof is all there. Something happened at copart between passing inspection in working condition, and the one month it took them to deliver my car.
We'll see what happens...I'd like to avoid legal matters. Just give me a check and scrap the car. I've been carless for two months. Be done with it.

Wtf??? Why did they send the car to copart? Copart is an auto auction. They auction off damaged and salvage titled vehicles. (I have purchased from them before) I have never heard of them doing inspections on cars. Sounds like your insurance company is hiding something. Seems fishy that they sent the car to copart in the first place.

Op, did you ever inquire where you're car was during the one month? It seems to me someone is hiding something. I'm sure the majority of everyone on this forum, including myself won't allow their car go missing for one month without inquiring. Your car looks like it was going to be savaged, and you got it back just in time. This entire story is just plain crazy. Good luck.

Op, I just read you want to avoid leagal matters. I'm sorry, I would strongly suggest taking legal action. You are setting yourself up for more headaches then you already have. You are taking a huge chance trying to settle this mess with two establishments that clearly didn't care about your car. Do you honesty think their going to just cut you a check that's going to cover what your going through? I don't think so. Please seek legal action, unless there is more to the story. Good luck.

Wasn't gonna reply but....

First things first, Encompass IS a LEGIT insurance company located in NJ. The link you posted is from "The internet" with 47 complaints should be disregarded, it about as reliable as dirt. The loop in the story is condition from release of the vehicle from you, to possession again to you.

If you have before and after documentation is all that matters, weather its pics, documents or whatnot. Your after photos look like they are very justified for you to win here, so if you have before docs mentioned above you will be fine.

My fear is you don't, or you will be soo mad you wont be able to convey your story correctly, gather your thoughts, documents and timelines and enhance your calm John Spartan. After you do this make a call to the claims at Encompass, show that you are upset but don't freak out. I would love to hear what they tell you after this call, keep us in the loop.

I really did inquire about the car while it was gone. There was a huge backlog from hurricane sandy so I let a few days slide. But then everytime I was told it would be delivered, it wasn't. And then when it was the day of delivery in december, no advance notice, I get a call while I'm in the carribean from the tow truck guy, saying he's in nyc with my car. They lost my keys and were going to drop it off. It was supposed to be delivered to Nj which it was finally Saturday.

I spoke with my claim rep, calmly. No threats or signs of anger. I need to get what I need first, docs. They sent out a field adjuster to see the car tomorrow. They said they have no idea what happened at copart but yes all evidence is there and documented. I'm trying to get copies, plus my own documents of before damage.

I will take legal action if I have to. It's just all new to me. As a 24yr old I can't say I know much about how all this should go down. Thanks for help here though.

oh my gosh, im so sorry thats horrible. i dont blame you for being mad i'd be furious.... keep your head up... and when you can either call or go down to the place and throw a big fit... tell them its unacceptable... and they need to either fix it, or pay to fix it.

no reason for that to happen. an ins company is not going to pay anyone for any type of labor like that.

i've had a few ins claims, and never had anyone pick-up or deliver my car, unless towing was needed. even still, i would pick-up once ready to be returned to me.

an ins estimate takes 10-20 minutes, top to bottom. these guys do it for a living. tack a week on for sandy, but someone holding your car for a month + is unacceptable.

i've had to move my car before w/ no battery, console does not need to be removed. selector boot comes right up, release pin can be pushed.

sounds like your car was stolen, by your ins co, via paperwork mix-up, and parted-out at copart.

were you present when it was delivered? i wouldn't have accepted, let alone pushed into my driveway.
