In Hamilton for the evening with some friends at a Tim Horton's.
Here I am by myself, in my car and on my phone, when all of a sudden I notice a group of people huddling around a van in the parking lot.

There are some loud voices and yelling and soon two people emerge from the crowd, lifting up their sleeves, about the pummel one another. Now keep in mind they are about 3 car lengths from me.

I immediately turn on my video camera and start filming them. There are about 15 people now, with the two fighters going at each other.

The fight progresses to the right and to the left and slowly towards my car.
All of a sudden one of them pushes the other straight onto my car and jumps right after him.

Almost stunned I keep recording and I hear the others finally freaking out telling them to stop and get off. They immediately stop and run in opposite directions. This is when I immediately get out of my car and chase them.

Realizing I can't do much even if I catch up to them, I head straight to the van.
I Take some pictures of the van and its license plate and then go back to inspect the damage. There are about 3 dents on the hood. Lots of scuff marks too...

I'll post pictures in the afternoon.

Any thoughts on how I should go about this? I'm guessing it’s around $300 at a PDR. But I have video proof and a license plate. It happened in a parking lot and these people were highschoolers/college students...

Post video - who knows maybe you'll get lucky and some of the local folk can identify them for you.

And then pass it on to policy if you ever hope on being reimbursed for the damage.

Not worth it for $300. We don't do things here like you Americans lol - suing everybody.

The culprit would be held personably liable and to enforce payment would have to be with the help of the police. Otherwise you go to small claims court which is a bi**h

Really no point in wasting your time.
If it was me, I would have done the exact same thing you did, and record the fight. However, anyone wiser may ask, why didn't you just leave when you had the time to avoid all of this?

For $300 you really shoudn't waste your time going through court. You could always file a report, and have the police deal with their criminal actions. But your most likely going to get squat . =(

Lesson learned: Stay out of Hamilton with your BMW, you don't see stuff like this in Mississauga lol

I beg to differ, this exact same thing happened by Mavis and Brittania in the parking lot in front of Marble Slab during the fall. 2 guys going at it and tossing pop cans at each other.

Instead of recording, and watching the fight, I got into the car and moved it across to the other lot in the same plaza.

Looking back, yes I should have moved the car, or even tried to stop the fight. I actually attempted to press the horn when they got near, only to realize that I needed the car to be on, in order to do so. At that same instant one of them was hurled right into my car.

I was just caught up in the whole thing like a trance. There were a few other older gentlemen spectating too. Oh well, shit happens I guess. Still debating whether to post the video up or not. If I do, I may feel like a jerk looking for cheap entertainment. Which to be honest, I actually was, witnessing something like this first hand. Didn't think it would come my way...

Taking it tomorrow to Thilan @ Dent Xpress. Will post pics then.

@ Dr.G - This was the Tim's with the double story McDonalds and a Fortinos, right near the exit to the highway.

Report this to your insurance company. Since you were not at fault, and there is evidence to prove this, you would most likely not pay a deductible and your insurance rates will not go up since you aren't at fault.
Then, if they decide, the insurance company will commence legal action against the at fault party to recover their claim payments.

I use to live directly across from this plaza when I was at McMaster. Every day when I opened my front door the first thing I would see was the Tim Hortons. In the 6 years I lived there not once did I see any trouble in that plaza. Sorry to hear about this man.
