Is my dealership screwing me

Car drives like complete ass from low rpm's. Stuttering, hesitating, violent jerking etc. I take it in and get told I'm beat on ANY warranty work related to this problem because it has catless DP's. I did not put the DP's on the car. I bought the car 4 days ago. It is a CPO. And lets be real the lack of cats is not going to cause the car to literally feel like its about to fall apart.
I guess what I'm really looking for is some advice on what I should do. This sucks. Big time.

Pop the ECU box open and see what's going on there. You might have a tune as well.

They sold you a CPO car with catless downpipes? Try to sell it back and/or never go to that dealer again, because they are clearly beyond negligent. 10 seconds under the car on a lift would show them the downpipes, so if they did even the laziest inspection of the car before certifying it, they would have seen the downpipes which aren’t even remotely similar looking to the giant OE cans. I don’t think it’s even technically legal to sell a road going vehicle w/out cats….The dealer sold you a car with warranty, and now won’t honor the warranty because of an existing part that THEY didn’t even bother to tell you about/even have knowledge of??? At best they’re incompetent; at worst they are actively screwing you out of your warranty.

last i checked... least in NJ... there is a 25K fine and other crap for modifying the exhaust system cats... you might want to look into that as recourse with the selling dealer.

Yup, I would have them take the car back and tell them they sold it to you like that.

If they don't take it back, I'd call BMW NA and tell them what the dealer did.
Tell them they sold it to you CPO with the catless pipes.

BMW NA doesn't BS around, i'm pretty sure they'd chew the dealer a new one if they found out.

Go 2 a different dealership. Thats some BS right there. If you got it from that dealership I would talk 2 the service manager and have him/her sort it out. Its a legal issue when it comes down to it since they broke the law. It was in their possession when they inspected the vehicle and sold you without informing you. Threatening them by blurting out "my lawyer" will be notified. Its a clear violation and should be taken care of free of charge. CPO or not its their responsibility as a dealership to make sure the car in fact is legal for the state requirements.

Well after hours on the phone with different entities inside and outside of BMW, I've come to the conclusion I am indeed screwed, but not by BMW. Here are the facts so far:


1. Car was CPO'd by a BMW dealer legitimately BEFORE catless DP's were installed.
2. Car gets traded in @ BMW dealer retains CPO status and is dealer traded to my dealer where I purchased it.
3. When I bought the car the dealer states catless DP's were indeed installed on the car.
4. Car drove like shit during the test drive and had multiple lights on dash, when questioned I get told "oh just take it to the dealer it's under warranty, they'll fix it". So I buy it because I just rode a train 7 hours from home and it's after 8 pm at this point so no rental car places open so I would have missed work, my father would have missed work and this whole journey would have been a colossal waste of time. (Looking back now I wish that I would have chosen to miss work -_-)
5. So I call BMW of NA to speak with a resolution specialist and tell them everything that went down in chronological order and the response I get is "The dealer you bought it from knew something was seriously wrong with the car and also was well aware no warranty work would be provided to you and you would be stuck with repairs". How were they well aware that work wouldn't be performed you ask? Apparently it was documented that they took the car in for the same issues just days before I bought it and got told to pound sand. So here I am with the broke car now. Pounding sand.

A seriously unfortunate story indeed. Fuck my life.

Where did you buy the car?

If you bought from them, fairly sure it was illegal to sell you a car that was catless in the first place... via their doing or not. They are supposed to make it road legal before selling it to the next owner.

That and unless you're throwing a service engine soon light, they have 0 reason for claiming thats the reason you can't have warranty work done.

They have to prove that THAT is the cause of the problem.

Lol but in all seriousness I was like idgaf warranty time lol. Yeah jokes on me. Looks like at this point ill be putting the JB4 on today to see if that helps or hurts matters. Then stock DP's from there.

Sorry I missed your post, they had me sign a "waiver" if you will in regards to the cats. Looking back now I see why -_-

If you can prove that the dealer knowingly sold you a "CPO" vehicle of which the warranty would not be honoured due to alterations, I would think that you have a case against the dealer. I would suggest that you consult with an attorney and then return the heap of trash they sold you...

Update: just read your reply that you signed a waiver... disregard my suggestion. This is, without question, a prime example of caveat emptor .

Wow, dude. You knew the car drove like shit, but signed a waiver absolving the dealership of responsibility and bought the car anyways?

In all seriousness, I highly recommend you take a responsible friend/family member along for car purchases. They'll stop you from doing those impulsive things that you'll regret later.

An fwiw I consulted my father who was with me and he said fuck it has a warranty who cares lol. Lesson learned I guess.

Codevo, I need to know what state you bought the car in and the name of the dealer? Did they have you sign an "BUYERS GUIDE" that stated "As Is tow away"? Did you sign CPO certification paperwork? Did they issue you a temp tag or transfer a license plate? Are they going to submit DMV (motor Vehicle) paperwork? I assume you paid cash? did you sign a "Rescission agreement"?

Get me the answers to these questions and depending on the answers I can most likely get you out of the deal with minimal brain damage.

I think you know in hindsight you made several critical mistakes, but the dealer made one huge one. I'm not going to tell you....because its obvious you cannot play poker! Thats your slap on the wrist. now start digging through your paperwork and get back to me.
