Dealing with insurance company

Hi all

So I damaged my driver side fender and front bumper on my 11 E92 M-Sport. The insurance company- Progressive is trying to put on refurbished OEM front bumper on it. Of course, I want them to replace it with the brand new OEM. Any advice in how to go about it and get the brand new OEM parts? Also, the damage is due to property owners negligence. I tried to have the insurance held the owner liable but no success. My insurance company is stating that I am at fault on the record. Any idea how demand for a "not at fault" status on my insurance record? Thank!

Need details on why the property owner is at fault before anyone can really make any suggestions. As far as the parts, if its coming out of your deductible, have the shop you're using spec out what parts you need to get it back to the way it was when you bought the car. If its original equipment/optional, you need proof that it came on the vehicle and that its not an aftermarket accessory. Most of the time, going to a BMW dealer should be all you need to get the list of parts/options you need to convince Progressive they are in the wrong and trying to cheap skate out of making it right.

Having been with USAA for 8 years, I've never had an issue like this. I have progressive for motorcycle insurance but thats a different beast entirely.

Thanks for the info Alpineswift. USAA is for military family only I think.

So the bumper got caught by a steel bar that was used to secure the concrete blocks on each park stall. Apparently, the steel was not trimmed or cut properly. It was sticking out about two inches from the surface of the concrete block. When I back out of the parking stall, i heard that the bumper and the fender were cracking. At this point, I am not trying to get the owner liable since there is no witness and had to go through a tedious legal process. All I am trying to do is to pay the deductible and most importantly to have the not at fault status on the insurance record if possible.

You may want to read the policy contract and if it states they could use after-market parts or some other mumble jumbo terminology, you may have a losing battle about refurbished part. I haven't heard Progressive using refurbished parts before, only after-market parts. I used to work for Progressive, but on the IT side of the things.

Great news! The bodyshop was able to settle it for me with all brand new OEM parts. I gotta pick a better insurance company or pay the premium to ensure all brand new OEM replacements in case anything bad happens in the future.
