It does not state whether or not you have to provide your password if your smartphone is locked once the officer gets it...and would that search be limited to the crash scene immediately after the crash, or would they extend that search... lots of questions.

I can see the point, though... too many idiots texting while driving because they just can't live without reading / sending SMSs as they are driving. Odd, that people think they are -that- important.

I feel if you were not talking, or texting you shouldn't worry if a cop wants to check if you were on the phone. I see so many driver's talking/texting and I feel it's extremely irresponsible of them. If an accident was caused because the driver was too busy on their cell phone, they deserve whatever is coming their way. My question is what if it was an emergency, and you needed to use the cell phone? I here there is a law cracking down on driver's who are caught texting. I here the Fines are going to be substantial.

As a cop myself, it sounds like this is a piss poor law. I hate distracted drivers as much as the next guy but there are constitutional protections I hold very dear. If I ask and you give it too me freely, well, that's ok. However, if I asked and you say, NO. Well, I would need a warrant to look inside and that is a buttload of work just to write a ticket (texting while driving is only a ticketable offense in Indiana). That law can't withstand judicial scrutiny...if it even gets passed.

Listening music/ radio also distract the driver? so next thing to be banned will be listening music/radio in the car? and talking to your friend/wife sitting next to you also distract some people while driving..that would be banned too?

California took on this initiative and now using your phone as a GPS device while driving is illegal in the state. It does not mean it is illegal to play with it, it is illegal period.
As far as the NJ law stands, as mentioned by a police officer in this thread, it will just create a bureaucratic mess. I don't text and drive, but I will say NO if I am asked to surrender my cell phone so someone can look through it, get a warrant and I will comply.

Something like this should require a warrant and can already be obtained by law enforcement or insurance companies after the fact if lawsuits are filed and the proper legal procedure is followed.

I agree that texting and driving is a problem, but this isn't the way to solve it. This is an infringement of privacy rights plain and simple.

I would never try to send a text while driving, but if the cops try to confiscate my cell phone, good luck getting access to it without my help. If you want to take some extra care to secure your cell phone against unauthorized access I suggest looking into full disk encryption as well as apps that allow remote backup, restore and wipe like Lookout. Always use a strong password, none of that 4 digit pin crap.

To be clear, it is illegal to operate a mobile phone in your hands while driving in the state of California. A "hands free" mobile phone can still be used for navigation and other functions (not texting).
