Truck reversed into me today :( help!

Hi,

I was parking into a spot today, and there was a truck parked on the side of the road,
as I was driving into the space, he reversed and hit me on the passenger rear side by the back lights..

I am assuming it's 100% his fault, but can insurance say different?
I was parking and the guy just reversed in to me.

I am not sure if there was a CCTV..
could it be my fault? damage is at least $3000+ apparently

and by the way,
he hit me with his big delivery truck so 0 damage on his car, it was a one of those steel steps at the back of the truck that hit me. It belongs to a big brewery company, should I call the company? I dont want to pay anything for this damage

like above, i was driving south, truck was parked like 10m away,
i turned left into the parking spot (toronto public parking on the side of the paved street) and as i was about 80% in he started reversing and hit me passenger rear by the lights.

whoever backing out cause an accident at his fault no??
edit: unless the incident occurred when the other party was getting out of the parking space.

Just file your accident report with the police and tell your insurance company. There's nothing more for you to do. I assume you didn't call the police at the time?

there is nothing about reversing vehicle,, i dont think

i didnt call them, but just went to the collision centre.
do you think i should call the beer company and let them settle it?

no statement, but a witness yes.
but later i found out that he was working with the other driver.
but they didnt seem like best of friends..

Unfortunately in parking lot accidents it is 50/50. Unless the owner of the property decides to lay charges but you said it's City of Toronto parking right? So unless the city wants to lay charges, you're out of luck bro.

A hit and run is a different scenario though!

In Canada, your insurance will always pay for your damages and the other parties insurance will pay for theirs. Afterwards, the insurance companies go after each other in court or settle it in other ways.

If you haven't reported it, hurry up and call the cops and drive in and report it at the closest police station to where the accident happened. You get to tell your side of the story first and usually, the police will side with the person that came forth first. Because you didn't run away and went to the police.

Lesson learned, get a dash cam I've got mine coming in the mail already because my wife's car got smacked in a parking lot and the d'bag ran away so we filed a police report, told insurance and paid no deductible and got the car fixed. No increase in insurance or anything. In fact, my insurance went down a bit...

GL and hopefully you get this resolved

yep, i filed a report right away,
the other driver didnt, he said he wanted to go deliver more booze around the town so he didnt go report. i am not even sure if he reported at all.

it's company car so i dont know the procedure for him.

anyways, if its 50/50, what happens?
because my car damage was at least $3000+

and his truck damage was zero.

so will my premium hike if it becomes 50/50?

If you are partially deemed at fault, rates could go up since there is a claim on your policy. Best to confirm with your broker or call the insurance company. Can also check if you have accident forgiveness on your policy. Good luck.
