it didn't "start" with 4.3.1. it takes time to develop software on that scale.
i am pretty sure they started working on it as soon as they realized that they can't milk jailbreakers and geeks (the main tethering market) for $20/mo, like they do with less technically inclined customers.
trust me, this has NOTHING to do with your firmware.
