Check the link and enter your VIN, it will let you know what firmware you have on your system. My X5 is 2010 which came with 2009 Maps on it. I had no issues in updating it to the latest version.
I used the link to validate I had latest firmware.

I do not have "Software Update" option in the Settings in Idrive....Going to start downloading the 2013 DVDs I guess..
