Deep packet inspection would easily reveal that the traffic is originating from something other than an iPhone. Whatever firmware you use, all network traffic goes through AT&T routers, and they know what you are doing.

I understand what you are saying but how come this only started w/ 4.3.1? Did at&t just get fed up and said enough since they were coming out w/ their own plan?
